The Federal Communication Commission’s campaign for censorship of media, particularly the television and radio outlets have lead to a flurry of consumers moving their eyes and ears to uncensored media formats. Although the FCC has good intentions, I believe that consumers will use their spending power in a way of voting against current regulations and censorship.

The Federal Communications Commission (FCC) was formed in 1934 under the Communications act of 1934 with the purpose of regulating interstate and international communications by radio, television, wire, satellite and cable. This agency is independent and is directly responsible to congress and its jurisdiction covers all 50 states, the District of Columbia, and the U.S. possessions. Five commissioners make up the FCC’s directors, all are appointed by the President and are then confirmed by the acting senate for a 5-year term. Specifically, “The Media Bureau develops, recommends and administers the policy and licensing programs relating to electronic media, including cable television, broadcast television, and radio in the United States and its territories. The Media Bureau also handles post-licensing matters regarding Direct Broadcast Satellite service. (FCC.gov)”

Recent events such as the complaints against various television licensees concerning their February 1, 2004, broadcast of the Super Bowl XXXVIII Halftime Show and the lewd remarks by Howard Stern in his national radios broadcasts have left the FCC with a difficult decision. Nearly 542,000 complaints flooded into the FCC (Adelstein) after the broadcast of the Super Bowl and have given attention to the some of the American public’s fear of a desensitized country. During the Half Time Performance, Janet Jackson’s breasts were bared for all to see when Justin Timberlake ripped off part of her clothing. CBS, which aired the Super Bowl, and MTV, whom produced the halftime show, both said they had no idea the performance would include a the display that it did. Apologies were offered by both companies for the incident. Justin Timberlake referred to the flash as a "wardrobe malfunction." "I am sorry that anyone was offended by the wardrobe malfunction during the halftime performance of the Super Bowl," Timberlake said in a statement. "It was not intentional and is regrettable."(Chamy)

Sparking an investigation by the Federal Communications Commission, as well as an avalanche of criticism against CBS and MTV, the FCC was forced to make a comment on the situation. FCC Chairman Michael Powell described the flash as "classless, crass (and) deplorable." Powell also stated that he suspects the show was a "stunt" rather than an accidental “wardrobe malfunction. (Horovitz)” His feelings may have been correct, a story posted on MTV.com earlier that week had the headline "Janet Jackson's Super Bowl show promises 'shocking moments.'" Bob Costas, NBC sports anchor stated his disgust by saying "It was a complete breakdown of common sense and common decency. The NFL doesn't usually leave much to chance. Either they completely dropped the ball, or they're being disingenuous (about being taken by surprise)."(Horovitz)

In response to this event, the FCC decided to crack down on several different aspects of the media. Under current rules a find of $550,000 was levied against CBS, which adds up to only about a dollar per complaint for the more than 542,000 complaints taken by the FCC (Adelstein). Television stations have been forced to make changes in their broadcasting formats. In an attempt to avoid another of five-star family fare turning into an X-rated joke the Super bowl XXXIX broadcasters, FOX, are taking several measures. In an attempt to bring back family viewing of the event, the National Football League has decided to take the reigns this year by signing off on every song sung, every outfit worn and every dance performed. The Super Bowl has become a cultural event and is also a huge business generator for the broadcasting station, this year revenues were expected to be close to $140 million (FOX.com). However in an act of defiance with careful cautions, the Fox executives were against any delay in broadcast. "We don't believe it's necessary," said David Hill, CEO of Fox Sports Television Group. After all, Paul McCartney — no threat to do the unexpected — is the halftime entertainer, he says. "When there's no potential issue, why bother with a delay?"(Horovitz)

Howard Stern is one of the raunchiest, disgusting and provocative radio hosts in America – and millions of people love him! Sterns language prompted the FCC to fine the parent company of several stations, which he airs on the amount of $495,000(Adelstein). When the Federal Communications Commission (FCC) announced that it would impose a $495,000 fine on Clear Channel for "indecent" content on Stern's show this prompted Clear Channel Communications to end Sterns contract. In light of this announcement, John Hogan, Clear Channel's President, said he felt he had no choice but to can Stern, for his show "has created a great liability for us and other broadcasters who air it. (Hilden)" Hogan also said he feared Clear Channel could be de-licensed if it did not get rid of Stern. Stern then lashed back through his own personal website stating, "It is pretty shocking that governmental interference into our rights and free speech takes place in the U.S." He then prominently posted a quotation from a Supreme Court decision: "If there is a bedrock principle of the First Amendment, it is that the government may not prohibit the expression of an idea simply because society finds the idea itself offensive or disagreeable." One of the most interesting parts about this case is that Howard Stern has been speaking this way for several years.

The government’s actions seem to be inappropriate and belated a great deal. The Bush administration had more than 3 years from the time of the event to do something, yet it has chosen to ignore Stern until it has now become convenient to peruse him. In response to the fines being levied against him, Stern has decided to move his show to Sirius Satellite Radio starting in 2006 (Coniff).

The five year multimillion dollar deal with Sirius will start Jan. 1, 2006. It has enormous implications for the 40-plus terrestrial stations that currently air his show, including Infinity powerhouses KLSX Los Angeles; WCKG Chicago; WYSP Philadelphia; KITS San Francisco; WBCN Boston; WJFK Washington, D.C.; and Stern's WXRK New York flagship (Coniff). Stern has been battered over the past year with the FCC’s decision but his decision to continue working in radio has really been a stance for free speech across America. "Howard coming to Sirius is great news for the music business," Greenstein of Sirius said. "I was going to get out of radio," Stern said. "I was going to get back into books and movies, reinvent myself. Then I realized that it wasn't that I hated radio: It was the situation. This is a whole new future. It was time for me to say, 'I am abandoning the old way of doing things."'

The threat of satellite radio has been recognized by traditional radio. The National Assn. of Broadcasters convention in San Diego in 2005 was frantically discussing the issue of censorship and the emerging media of satellite radio. Several radio general managers and executives seemed to be speaking in hushed tones about the implications (Reuters). Fortunately the problem of censorship in traditional radio has been answered through the revolution of satellite radio. Stern is probably one of the happiest radio hosts and will continue to lead the revolution. "This is the day satellite has become a business," he said. "I've already gotten so many calls from people who want to defect. I'm going to put Clear Channel out of business.” Said Stern.

Howard Stern has some of the most loyal listeners in radio and have moved their listening habits with Stern has he has moved from books, pay-per-view, movies, TV and now Sirius Satellite Radio. Sirius is making a reasonably safe bet that Stern’s millions of fans will follow him again and become subscribers (Sirius.com).

This deal is just part of the reason that Satellite Radio is becoming a household name and brand. The hope for Sirius and the music industry is that this movement will translate into a huge increase in subscriptions to Sirius, as well as an important outlet to expose music, which will be free from government regulation. Stern believes that Clear Channel Communications does not stand for free speech, and this violates his own principles. His decision to migrate to satellite radio is a creative decision. He acknowledges that his walking away from an empire where advertising rates are higher than ever and listeners are growing at a steady pace.

One of the latest rulings by the Federal Communications Commission appears to suggest that news stations are also under fire (Bivins). This decision stems from an incident at the Golden Globe Awards, when U2 singer Bono said the F-word and NBC carried it live. The FCC investigated and said the indecency rule did not apply because Bono used the word as an adjective, "to emphasize an exclamation." However, after the furor over the Janet Jackson "wardrobe malfunction" at the Super Bowl, the commission overturned the Bono decision. The F-word, the FCC said, is indecent and profane regardless of context. (Potter)

The three words "regardless of context" are what have broadcast journalists concerned. In the past, the FCC considered the context in which profanities were uttered in deciding if a broadcaster could be fined for indecency. Sexually explicit comments by Bubba the Love Sponge and Howard Stern could get a station in trouble — no doubt about it. Clear Channel Radio dropped both shock jocks this year after being hit with record fines (JAC). Comments on a newscast and during live news coverage, in the past have not merited sanctions. Stations now worry that will no longer be the case. The FCC hasn't specifically said how this recent decision would apply to news broadcasts. "Right now, the problem for us is there are no rules," Rod Fritz, news director at Boston's WRKO-AM radio, said at a panel discussion at the April convention of the Radio-Television News Directors Association. "There's no line. We don't know where the line is." (Potter)

Petitioning the FCC, CBS affiliate stations gave a rebuttal to the indecency rule. They stated that this new rule could "fundamentally alter the manner in which local broadcasters engage in news gathering." (CBS) The stations went so far as to warn that if the ruling stands, many of them would stop airing newscasts between 6 a.m. and 10 p.m. when the regulations apply.

This may be taking things a little too far, but they do feel threatened and they do have just cause for concern. Until now, being found in violation of FCC rules for indecency merited not much more than a slap on the wrist and little more than a maximum fine of $27,500 per show regardless of how many profanities were aired. But the FCC has started fining stations for each profane word used. The United States Congress, whom directly controls the FCC, has raised the fine to as much as $500,000 per incident (Hilden). One provision under consideration would start proceedings to revoke a station's license if it's repeatedly found in violation. With this type of ramifications being taken out on the stations, the parent companies of these media giants have little choice to shape up and drop some of their more risky on-air personalities.

Consumers are moving their eyes and ears to non-regulated media. Recently two satellite radio companies have been vying for new subscribers by enticing them with programming ranging from Howard Stern to the Playboy Channel, to NASCAR and live Major League Baseball broadcasts. Sirius and XM Satellite Radio are free from FCC regulation, meaning that any subscriber paying $12.95 per month will have access to their content. The 2 companies are so confident that subscribers want this content that they do charge additional $2.99 per month for access to premium content such as Howard Stern’s Show which is to debut in 2006.

Satellite radio is a new service being offered by two companies, XM Satellite Radio and Sirius Satellite Radio. Both companies are offering over 100 channels of streaming music and entertainment. High quality sound is achieved through the use of satellites orbiting high above. Satellite radio has been commercial free and free from regulations by federal committees. The Federal Communication Commission is making the effort to censor the American public from indecent pictures and vulgar language. At this time of this article, XM Satellite Radio had 3.4 million subscribers (Xmradio.com) and Sirius had 1.6 million subscribers (Sirius.com), all of whom are willing to pay a monthly fee. This does act as a testament of what is to come regarding this medium of entertainment and information dissemination. Consumers are voting against the way that media is censored through their purchasing power. I do believe that the FCC is doing their job and will continue to do their job, however they do have plenty of roadblocks in their way and I do foresee more in the future. While the FCC has a duty to perform, businesses will continue to cater to the public’s need and interests – in this case the consumers are winning.

Cultural and national negotiation styles reflect communication behaviors and the priorities of that culture. Priorities such as trust, teamwork, non-confrontational situations, and openness are all along a sliding scale with each culture. The communication behaviors of each culture reflect these priorities and can dictate how a culture will engage in negotiations. Often, Japanese and other Asian negotiators will plan a social event and dinner before any real negotiations occur. Likewise, Americans place an emphasis on taking clients out to dinner and a round of golf. Engaging in this type of activity builds trust and opens the line of communication between the two parties. Using persuasive techniques to “connect” with another person can lead to trust and the sense of a relationship being built. The negotiation styles of these two cultures mesh well, thus allowing them to understand the priorities of each other’s culture.

Once a relationship has been built on trust, the negotiators can begin sharing information. This level of openness is highly dependant on the level of openness for that country. This stage in negotiations require each party to fulfill their end of reciprocation – which can sometimes make one party feel like they are being confronted - but if done correctly can develop “quick trust” (Brett, 207). Quick Trust develops when two groups share information and allow the other party to see their weak side. Obviously developing trust is important, however some cultures simply may not be comfortable with divulging information quickly.

Getting Down to business: Using Culture to Persuade Arguably one of the most important factors in negotiation is an understating of the culture in which you are engaging in negotiations. Cultures vary in their openness and in the time that business in conducted. Terms of agreements should be taken into consideration; for example, Italy has a 90-day billing cycle versus the “normal” USA 30-billing cycle. These cultural norms are very important for understanding how to succeed in negotiating on a global scale. Building relationships is the key for building trust among partners or potential clients. Trust can become an all encompassing factor when it comes time to make a final decision, the understanding of what is expected and following through will allow negotiations to flow smoothly.

By Scott Fish 1) Title Tag � When we�re talking about SEO Technique, the Title tag is one of the best and most powerful tags that you can use. Every page should have it�s own title tag, each tag should include the keyword that you are targeting, along with sub-keywords associated with the main keyword that you seek to drive traffic from. 2) ALT Tags � These tags are most often ignored completely. Who would have thought that tags, that were meant to be for text browsers because the images didn't show in text browsers, would become part of a technique to raise the keyword density of a webpage. Your main keywords need to be included in some ALT tags- be careful, over-doing this could cause you to be banned and your PR could drop. 3) Link Popularity - Link popularity is the most powerful SEO tool, (arguably, of course). Typically a website must have a link to it, in order to be looked at by the spiders. This means that you should have at least 1-2 links going into your site from another website that has been visited by the spiders through search engines. Increasing Page Rank, depends on the number and quality of the sites that link into yours. Keywords should be in the links, along with sub-keywords. Keep the links short; this creates an easily readable keyword term for the search engines to recognize. 4) Keyword Density � Research first � Then decide on the keywords that you want to target. Don�t over do it- you should use the keywords only once in the title tag, once in the heading tag, once in bold text, and then shoot for the density to be between 5% to 20% . Keywords should also be strategically located throughout your website. Place them in all locations. Several search engines will recognize bottom of the page or sidebar text/links and discount them, this is because many website designers will load certain sections with clutter. 5) Page Size - Try your best to keep your web page over 5k and under 15k in size. I just designed one that is close to 53k, this is mostly because of pictures and a flash file being used, rule of thumb�. Look at Yahoo! And Google, These are some of the fastest loading pages, and most popular, people don�t like to wait � even if you have �cool� graphics and pictures. Your web page's speed is important: robots will be able to spider your web page faster and easier. 6) Theme Rich in content - Search engines are looking at themes rather than just the words or pictures. Content is King � I know, you hear it a lot, but it�s true! Webpages should have content that's related to the targeted market. Link your visitors to other valuable and related content within your own site. The more pages the better. A good tool that I have found to show you linking info is: http://www.UpTimeBot.com You can preload upto 20 pages and then refersh them, it shows all the vital information, along with how many pages are indexed from each search engine. 7) Cross Linking within your Own Site � You rely on other pages linking into yours � in order to get indexed; the same is true for all the pages within your site. Any new content should be easily reachable through 1-3 pages of content. Linking back to your main home page, or a storefront will help you get indexed faster and achieve a higher Page Rank. Some of the basics when it comes to SEO and getting high ranking in search engines starts with using a keyword and then placing it strategically throughout the website in content, title, headline, etc. Using the keyword multiple times in your content is great, but lets look at something that a lot of websites completely overlook. Simply put���. Take your keywords and current links within your site and USE them! What I mean by this is, you have certain keywords that are spread across your website. You also have links going to other websites, affiliates, advertising, resources, etc. Combine your links with * Relevant * keywords and you will see an increase in page rank and traffic due to the increase in PR. Just take a few minutes ��� scan through your site ��� find links that may be the name of a company, anything that says ���partner��� or ���affiliate��� -- Change them! Make them say anything related to your main keywords. Follow this strategy, it takes just a few minutes and this plus other simple strategies will add up to a good increase when your key words are searched for in search engines. Sitemaps are without doubt one of the most often ignored and undervalued aspects of search engine optimization. You've probably spent a huge amount of time working on pages of original content, keyword density and getting incoming links but never once spared a thought for a sitemap for your new creation. What is a sitemap? Put simply it's a page or pages that contain a list of and link to all the other documents on your site. This is useful on two levels: 1. Your visitor can quickly reference all the documents on your site to find exactly what they're looking for. 2. Search engine spiders can also quickly find and index every single page of your site in the least amount of time. The SEO benefits of using a sitemap far considerable and should not be ignored. This is a win-win situation for you, your website visitors and the search engines. Put simply you're nuts if you've not included a sitemap as part of your overall website promotion strategy. The good news is that it's never too late to start. You can create a sitemap page today but there are some rules to creating an effective sitemap that you need to follow: Your sitemap must only be linked to from your homepage and no other page. Why? You want the search engine spiders to find this link directly from your homepage and follow it from there. Your sitemap MUST NOT be linked to from every other page of your site. Also from a Google Pagerank point of view only linking to your sitemap from your homepage can also "funnel" PR quickly to pages all over your site. If you have a large website of 50 pages or more limit the number of pages listed on your sitemap to a maximum of 30. This is to prevent your sitemap from being misinterpreted as a link farm by the search engines. It also makes the sitemap a lot easier for real human visitors to read through. Limiting the number of pages listed on each sitemap to 30 might mean splitting your sitemap over 5, 10 or 20 pages. This has to be done and the long term benefits are worth it. Bear in mind that if you do create a 20 page sitemap you've just created an extra 20 pages of content for your website! Make absolutely sure that each of your sitemap pages links to the next. If you have 10 sitemap pages in total then each of those needs to link to every other sitemap page. Otherwise both visitors and search engine spiders will find a broken link, lose interest and go away. Test your sitemap thoroughly. Make sure all the links works. Make sure it's easy to read and navigate through. Your sitemap is there to assist your visitor and not confuse them. How should you structure your sitemap? The following tips must be adhered to in order for your site to gain the maximum possible benefit from having a sitemap. 1. The title of each sitemap link should be keyword rich and link directly back to the original page. 2. Include 10 - 20 words of text from the original page of content underneath the relevant sitemap link. This creates more content for search engine spiders and human visitors can see exactly what each page is about in advance of clicking. uman visitor benefit is that they can see what the pages is about in advance. 3. Ensure that the look and feel of your sitemap page is consistent with the rest of your site. Use the same basic HTML template you used for every other page of your site. So now you understand the importance of building a sitemap for your website. 5 Things to Keep an Eye on in the SEO World in 2005.... After the latest PR update at Google and MSN’s beta search going live, there is one thing for certain in 2005: the world of search is in for some major changes. There has been growing speculation around the SEO world that reciprocal linking is a thing of the past. Rumors are abound that PR means less and less, if anything. Bill Gates came out of his cave to say that “Today’s search is nothing” and that it won’t be that way for long. There are quiet rumblings in the SEO back alleys of a new, state-of-the-art search engine currently indexing the internet. Websites are dropping off the face of the planet. And we’re all left to sit here and put together the pieces. So what is in store for 2005? 1) Reciprocal links, while not becoming totally dead, are decreasing in value, and there will most likely be an algorithm update to lessen their importance. The original thought process behind the importance of a link was that it was seen as a “vote” for the linked-to site. Now that reciprocal links are everywhere, it is hardly a great way to count “votes” for a website. Reciprocal linking will continue around the internet, although the amount of people who try to get away with one-way links (by never getting back to you once you’ve added their link) will increase significantly. This will, of course, be an attempt to acquire one-way links, which brings us to our next subject.... 2) One-way links and triangle linking, though already quite popular, should explode over the course of 2005. Both are much harder to control and acquire, which makes Google happy. The triangle link “ploy” makes links look like one-way links even though “Site A” is returning the favor to “Site B” through “Site C”. There will be attempts to sell triangle linking programs and systems by SEO companies, however, the complexity, difficulty and time involved in this scheme will produce ridiculous prices. 3) What this about a new search engine that is going to index every site on the internet, EVERY 10 seconds? Become.com has turned a few heads with it’s claims. Site owners have reported Become Bots spidering “like crazy”. It’s all quite hush, hush, however and you need to have an invite in order to test it out. It should be interesting to see what they’re capable of if and when they decide to go live. I’ll go out on a limb and say that it’s a household name by this time next year. 4) MSN will scrap the “beta” tag on February 1st from it’s sparkling new search engine, which is currently live at search.msn.com and Bill Gates thinks it will rival Google. There is a lot of debate over this issue, but there is no denying that it is far better than the old chugger they were using before. Love him or hate him, Gates has most likely given a hard right to the chin of Yahoo!, which seems to be suffering from a magnitude of quality problems. MSN will be second to Google in total searches in 2005. 5) PR still has importance. However, it is also decreasing in value. PR is only based on the quantity and quality of links (both inbound and outbound) from the given web page. The most obvious reasoning for the declining importance theory is due to the fact that on any given search on Google, the PR of each page seems to have barely any correlation with it’s place in the rankings. Search Engine Optimization (SEO) must be considered a process and over time you can build your ranking and traffic. Remember, “Rome wasn’t built in a day.” This article provides 10 SEO tips that will build your search engine rank. 1. Title The Title is (usually) the hyperlink provided in the search results so make sure it’s people friendly. Put the most important keyword first, followed by the 2nd…If you need to have your Company name there (branding), put it at the end. 2. Meta descriptions Use the keywords once or twice in your Meta description. It can be the text that shows up in the description area of the search engine results. 3. H Tags (and proper use) Have your keywords in an H1 tag at the top of your page embedded in a good description. Not only will it help your rankings but many times the search engines will actually display it in their results. 4. Keyword positioning (on the page) Have your main keywords high up in the page (the higher the better). The most valuable real estate on a web page is top left corner – people (& engines) read left to right starting from the top. 5. Number and Quality of inbound links Each link from another web site acts like a vote of confidence – A link implies that the site believes your site has value. However, all links are not equal. You must get links from sites that have a similar theme to yours ONLY! Anything else may actually hurt your page rank. 6. Linking Text/Description When building a link campaign, make sure to use keywords in the link. For example, a link with “click here” doesn’t help you with search engines. A link such as “Internet Marketing” is much more effective (if that’s your keyword). Also, don’t forget to use keywords in your linking description as well. Content is “King” Not only is quality content what people are looking for, but content is also what the search engines are looking for. Content is basically “food” for the search engines. Also, while you want to mention your keyword, DO NOT “keyword stuff”. A too high word density will penalize you – make it natural. 8. File size Keep file size as small as possible. It will make for faster loading pages, happier visitors and the search engines like them. 9.
