The War on Terror Election Day Scorecard
On this election day one of the questions you have to ask yourself is How is the War on Terrorism going. It is a central question in the election. Do we want to go in a different direction or do we want to stay on the same corse. That is the question but to answer it you have to look at what terrorism really is and how you fight it.
Terrorism is defined as a violent act designed to cause fear, chaos, and panic. Terrorism is a strategy of asymmetrical war fare. A small band of people taking on an enormous power. It has been used throughout history by people from all nations. It has become a more popular as the killing capacity of weapons has evolved over the centuries. Terrorism is born out of frustration and helplessness. The terrorist organization uses its small size and desperation as a potent tool. They are hard to locate, hidden within the greater population and are united by a fanatic belief. They are dedicated to use violence to bring about political and/or social change. They have no qualms about killing innocent civilians, after all they have little too loose and much to gain by their actions.
Their goal is to sow fear throughout the population, to drive a wedge between the people and government as well as the government and it's allies. To goad the victims into some kind, any kind of action. The response gives them legitimacy. Terrorists know their strategy is long term. They know that one attack won't realize their goals, but it could set in motion a chain reaction of events that lead to change . "You can't kill an idea with cannon balls" ..Napoleon
There is no quick fix in a battle against a terrorist organization. You can't fight terrorism with a military strategy. It doesn't work..A massive military strike against a terrorist only shows your weakness and fear. It makes the terrorist organization looks stronger and helps bring people to their cause. Fighting terrorism is a long term, multi headed strategy that is more subtle and low key than America is used to. You have to use law enforcement and intelligence operations which are under the radar to wipe the terrorists out and prevent further attacks. Steps must be taken to dry up the terrorists source of funding. Care must be taken not to fall into some repressive action as you try to route out the terrorists from the regular population.
At home the most important thing is to calm the peoples fears in the wake of the attack. People get over the initial shock of the event, but its that feeling of waiting for the other shoe to drop that creates fear and panic. You must also be consciously aware to maintain the moral high ground that comes with an unprovoked attack against innocent civilians. Repression and draconian measures must be avoided as you try to root out the terrorists from within the general population.
This kind of warfare always comes down to security versus civil liberties. A task much harder in a democracy like the United States where free speech, freedom of assembly, the free exchange of ideas, due process, and the Right to Privacy exsist.. These very freedoms provide the cover for the terrorist to recruit, plan, and carry out their mission. A successful counter strategy strikes a balance between civil liberty guarantees and the public's desire for safety. When you throw away the rule book you lose the battle of perception.
In looking at the US response to 911 the first thing you have to examine is how the Bush Administration's ideology shaped the war on terror.
President Bush and Vice President Cheney both believed Congress had overstepped its bounds in the wake of the Watergate and the Iran Contra scandals. Congressional reforms had the effect of weakening. the institutional power of the President. They campaigned on it and made no secret about wanting to restore the Power of the Presidency. Both are believers of a principal called the Unitary Executive Theory which has a very expansive view of Presidential Power, in some instances unchecked power with very few limitations.
The Theory postulates that since the Constitution puts the sole power of the executive branch in one person, the President, he and only he can determine how that executive branch functions. According to this theory in times of war the power of President as Commander in Chief is supreme. Anything he does to conduct a war is legal. The President cannot be constrained by Congress, only the courts. The War on Terror became a perfect vehicle to restore power to the office of the Presidency. It put the President in Commander in Chief mode to wage a war without end. .
The Office of Legal Counsel (OLC) are the battery of lawyers the President turns to for legal opinions. The OLC are part of the Department of Justice. They advise the President on the constitutionality of any law he proposes or action he wants to take. Their opinions become the law by which the Executive branch operates.
The President gets to fill all the positions of the OLC and Bush filled it with lawyers who all shared the Administration's belief in the Unitary Executive Theory.. The Bush administration would develop policies or programs to fight the war on terror that would in some way expand the power of the presidency. They would run these plans through the OLC for opinions on wether they were "legal"and within the Presidents powers and authority.
The OLC would in turn write a legal opinion rubber stamping the administration position basing their opinion on the Unitary Executive Theory. Until they were challenged in court these opinions would turn into defacto laws and govern how the executive branch functioned. At the time John Yoo, a former college law professor and one of the most extreme proponents of the theory was an OLC Deputy Attorney. He advocated that a U.S. President in the exercise of his war power cannot be checked by Congress or any United States or International law.
In an interview Bush gave the Houston Chronicle when he was still the Governor of Texas he was asked about his father's Presidency. The future President told the reporter that he felt his father had "squandered" all the political capitol he had generated after the US military pushed Iraq out of Kuwait. That he should have used the political capitol to push on to Baghdad as well as further his domestic agenda. Bush went on to explain that faced with the same situation he would use all his built up political capital to get everything he wanted done. He would have a "successful presidency" unlike his father. "One of the keys to being seen as a great leader was being seen as commander in chief," he stated.
This was the backdrop of the War on Terror

The Bush Administration was in a panic after 9/11. After being warned that Ossama Bin Laden and Al Queda were the biggest threat facing America by the out going Clinton Administration. . The Bush administration chose to focus on missile defense rather than terrorism. The 9/11 Commission laid it all out. There was enough chatter out there about an attack against the United States and enough information known by the FBI and CIA including warnings from friendly intelligence services that if the Bush administration was concentrating on Al Queda 9/11 very likely would have never happened. One thing for certain the most important thing the administration was set to do at all costs was stopping another attack. In order to do that , the Bush administration needed information or "actionable intelligence" They were ready to go to any lengths to get it "When terrorists kill 3000 American citizens, we look at it as an act of war and not a law enforcement problem," a Bush administration official stated.
Making the response to 911 a military operation instead of the usual law enforcement and intelligence operation gave the United States the ability to kill and/or capture as many terrorists as possible. Once terrorists were captured they needed to be interrogated to get actionable intelligence that would hopefully stop the next attack that the scared the administration believed was coming.. When it came down to it the Bush Adminstration chose aquiring actionable intelligence over the legal tradition of Due Process.. If terrorists weren't going to talk, we were going to make them talk.
The Bush administration had to find a way around the Civilian and Military Justice systems as well as the Geneva Convention, the Uniformed Code of Military Justice, and various US laws that Prohibit torture.. The Fifth Amendment protections against being deprived of life, liberty, or property without the "due process of law." as well as the Sixth Amendment guarantees that a defendant be informed of the nature and cause of the accusation they are charged with; confront the witnesses against him; the ability of obtaining favorable witnessess , and to have the Assistance of Counsel, were seen as burdensome to the War on Terror.
The problems of trying the prisoners in Civilian or Military Courts were many. Discovery threatened to reveal National Security assets and or sources and methods of intelligence gathering. Once you violated a prisoners Fifth and Six Amendment rights, which extends to all non citizens within the United States you can't bring them back into the criminal or military justice systems. Most importantly in an open court the methods the United States was now using on prisoners to extract information would be exposed.
Prohibitions against torture go back to the Nation's founding. General George Washington made it a point that all prisoners of the Continental Army would be treated humanly and not tortured, that this New Nation would not stoop to the level of the British and other countries who routinely tortured prisoners. The Geneva Conventions signed after WWII are the World's laws on the conduct of war. It defines the treatment of prisoners of war, refugees, civilians and spys, and bans any kind of torture as well as inhuman and degrading treatment Under the Bush Administration the United States became the first signatory country to violate the treaty as a matter of policy. The Office of Legal Council wrote two classified opinions that declared the President had the power to suspend the Geneva Conventions because terrorists are not solders and therefor not subject to Geneva Protocols. They got around the Torture restrictions by defining that torture's intent is to cause pain and suffering. The Goverments ' enhanced interrorgation techniques" didnt rise to that standard because pain was inflicted to elicit answers to questions. It wasn't done to cause pain just for pains sake.
The Administration had to find another way and the Office of Legal Counsel once again provided it. The OLC determined that as Commander in Chief the President could declare anyone he desired an "illegal enemy combatant". They were a new class of prisoners outside the traditional jurisdictions of criminals and POWs. The OLC created a whole ad hoc detainment and trial system to guide their prosecution, where there were no 5th or 6th amendment privilages, and torture was institutionalized. Illegal enemy combatants could be held for years without being charged, without contact of lawyers or family. Trials were conducted in secret using secret evidence. This military tribunal system was over seen by the Commander in Chierf. Completely removing the enemy combatants from the Judicial system.
Because the Fifth Amendment guarantees were extended to non citizens in the US, the detainees had to be held somewhere outside the United States. The decided on Guantanamo Bay Cuba. It was outside the United States which the OLC felt met the requirement while under US control so the administration didnt have to worry about exposure.
This whole system of Presidential Military Commissions and the administrations institutionalization of the use of torture caused a firestorm of protest, the Military Judge Advocate General, the Pentagon, Colin Powell, and the Joint Chiefs to name a few. The arguments were many. Soldiers weren't trained to torture prisoners . The information obtained was usually unreliable because prisoners will say anything to make the pain stop. They all believed that if word got out it put US service men at risk besides destroying US credibility, and result in world wide condemnation
Despite their protests the view of the President, Vice President and the Justice Department prevailed. The quest to increase the power of the Presidency as well as the need to get information to prevent any further terrorist attacks was more important than two hundred years of legal precedent and history. The OLC orally briefed The Department of Defense, FBI and CIA on the new policy. They were given their orders, a list of approved torture techniques and told to go at it.
The Office of Legal Council also authored the memo that formalized the Bush Doctrine. The OLC stated that the US had the right to depose foreign regimes that represented a potential or perceived threat to the security of the United States, even if that threat was not immediate. It stated that the US would treat countries that harbor or give aid to terrorist groups as terrorists themselves. A doctrine of supporting democracy around the world, especially in the Middle East, as a strategy for combating the spread of terrorism; That the administratoin had the right to act unilateraly and premptively against real or perceived threats. Some of these policies were codified in a National Security Council text entitled the National Security Strategy of the United States published on September 20, 2002
The Bush Doctrine was the impetus for the invasion of Iraq. It was the next step in the War on Terrorism. Some of the intelligence used in justifying the invasion;. Iraqi connections to Al Quedah, their desire to obtain and use biological weapons, were all aquired through torture, then later recanted.
Once the US defeated the Iraqi army and Saddam Hussein went missing the need for actionable intelligence to find the Weapon of Mass Destruction and Saddam was paramount. As the days turned into weeks and neither turned up, pressure from the Administration mounted. The result was that the enhanced interrorgation techniques used in Guantanamo were brought to Iraq in the form of Task Force 20. A combined Navy Seal and CIA taskforce sanctioned by the President, VP and the Joint Chiefs. Using torture techniques signed off by both Attorney Generals Ashcroft then Gonzalez and the head of the DOJ Criminal Division Michael Chertoff (mow homeland security head) the Guantanamo Model was put in place in Iraq. The Geneva Protections for Civilians in Occupied Territories were ruled not to extend to Iraqi citizens.
Here at home the President used the Republican led Congress as a rubber stamp to codify and legislate into law its imperial power grabs through the War on Terror. Majorities in both houses ensured the legislation the President wanted passed. Painting any dissent as unpatriotic and damaging to the war of terrorism

Right off the bat the administrations decision to fight terrorism with a military strategy was a loser from day one. Rather then go with a long term strategy that combined active (law enforcement and intelligence gathering) and long term passive (civic action programs) measures designed to address the root causes that give rise to the hoplessness that breeds.it Declaring it a military action served a political purpose as an excuse to increase the President's power not a strategic one designed to combat terrorism.
The Military option showed just how scared the Bush Administration was of another attack. It also helped deflect the attention from their failure to protect America despite being warned by the Clinton administration that the greatest threat to the US came from Ossama Bin Laden and Al Quedah. It was such a serious threat that President Clinton had lifted the ban on assassinations giving the CIA the license to kill him if at all possible. The Bush administration however elected to focus on Missile Defense instead, only holding two meetings about terrorism before 911. In a little more than a month after the attack President Bush declared a War of Terrorism that began with the invasion of Afghanistan and a little more than a year and half later the War in Iraq
The Bush administration had widespread support for the invasion of Afghanistan but the Declaration of th Bush Doctrine caused many of our allies to step back. The Invasion of Iraq and the ensuing occupation causeda rift with some of our allies and has acted as a recruiting poster for Al Queda all around the world.
When the Bush Administration authorized the use of torture to coerce confessions from prisoners of war it became the first signatory to the Geneva Conventions to wilfully circumvent them. Before it became public it caused a firestorm within the administration from both Colin Powell at the State Department and lawyers from the Judge Advocate Generals Office. After the pictures became public from Abu Garib we lost the support of many of our allies. When it came out it was official US policy to torture prisoners it destroyed the image of America around the world.
Rather than trying to quell the fears of Americans and unite them, the administration fed them. Fear of another attack was used effectively to drum up support for the presidents policies. The administration used information coerced from tortured prisoners to fan the fears of an immanent nuclear strike by Saddam Hussein to scare the American Public and Congressional opponents into supporting it's invasion of Iraq. They also used made up terrorists alerts and the raised the specter of Osama Bin Laden in the weeks before the interim Congressional elections of '02 and 04' to scare the public into support for Republican candidates.
There was never an attempt to unite the public in the fight against terrorism. There were no fireside Chats or calls to sacrafice from the public by the President. Dissent was snuffed out by the administration who painted opponents as soft on terrorism. The administration questioned their Patriotism while accusing them of failing to safeguard the American Public. The Valerie Plame case was a blatant attempt to discredit and destroy anyone who dissented against the administrations policies. The Vice President's Chief of Staff Scotter Libby was convicted of perjury and obstruction of justice in the case.
On this election day you have to ask yourself. Who is winning the War on Terror. It certainly isn't the Bush Administration.
There is no Victory in a war on terror. You don't get to declare yourself the winner, pack your bags, and go home. It doesn't work like that. There are no clear cut Winners and Losers. It is all shades of grey. Each side gives up something to achieve a stalemate they can live with. All it takes is a bombing, a shooting, a kidnaping, it doesn't even have to be successful. It just has to be attempted and your back where you started.
Osama Bin Laden is still free. Since being driven out of Afghanistan, Al Queda has spread into Iraq, and other countries in the Region as well as the far East. They have launched successful terrorist attacks in Bali, Spain, Afghanistan and most recently in Pakistan killing 54 in an attempt to assassinate the countries new Prime Minister. In a stunning escalation, the bomb was found to contain an accelerant made from aluminum powder which added power to the device and caused the fire to burn at over 1200 degrees rendering useless the hotels sprinkler system and causing a 27 foot deep crater.
This comes on the heels of what the Joint Chiefs of Staff called "sophisticated and well coordinated attacks against US forces in Afghanistan by Al Queda unlike any we have seen before." Recent reports state that the situation is deteriorating and more troops are need to deal with a resurgent and better armed Taliban. The CIA and the Pentagon feel that AL Queda is almost as strong as ever. That the organization has spread to other nations in the Middle East and Asia. It may not be able to strike within America but it capable of attacking United States interests around the globe.
. Al Queda has been more successful in creating a chain reaction of events that still reverberates to this day. The economic effect because of rising costs for security that the nation has had to bear, a two front war that is costing the nation over 100 billion a month, billion dollar losses in the travel and tourism industry, the day after 911 the stock market crashed posting its greatest single day loss in history until the recent economic meltdown. The chain reaction also occurred on a political level, The attacks had a marked impact on the 2002 and 2004 elections, it has created a rift with many of our Allies in Europe. It has destroyed American credibility throughout much of the world. The effects on everyday American life have been extreme, leading directly to a curtailment of the civil liberties that are the foundation of the country. It has changed the way we travel, the way we think and the way we now look at the world.
It is obvious from the beginning that the Bush Administration was more intent on increasing the power of the President than winning the war on terror. Ossama Bin Laden is still free and for the first time in US history the President now has the ability to lock up United States Citizens, deny them due process and habeus corpus protections for as long as he wants thanks to the Military Commission Act. The last piece of legislation the Republican Controlled Congress passed on the eve of the 2006 Congressional elections.
In the long run the loser is the American people. Osama and Bush both got what they wanted. The American people are stuck with the bill on an economic, social and political level. It is time for a change. It is time to end the politics of fear and division and get back to being America again
John McCain's declaration to stay in Iraq until we achieve Victory shows just how out of touch the Senator is on the Iraq war. The Joint Chiefs stated that there is no military solution to Iraq. That any gains they have made are fragile and reverseable. Even President Bush has downgraded his expectations to success rather than victory. How many billions of dollars must be spent, how many more lives must be wasted in order to achieve his Victory. John McCain is still fighting the Vietnam war. He is not the man to be leading the war on terror.

There are many cards that the McCain campaign has played. The Inexperience Card..The Gender Card, The Fear Card, .The Race Card. There is one card that the Campaign has shamelessly played that nobody has talked about.. The Canadian Card .
What exactly is The Canadian Card? Simply this. When your selling something to America, if you can't baffle them with bullshit, Dazzle them with a Canadian.
Senator McCains choice of Sara Palin for Vice President was the campaigns Canadian Card gambit Americans love Canadians. It's our Nation's dirty little secret. We won't come out and say it but it's the truth. We can't get enough of them. On TV, the Radio, the Movie's they are everywhere. Sara Palin was a great choice not because it solidified the conservative republican base but because it was appealing to independent swing voters because she brings out an American's "inner Canadian"

There something about a Canadian we as a people can't resist. They make Americans feel safe. They make Americans laugh. They make Americans Cry. They make us feel good in general. Maybe the way they talk hits a subconscious chord, creating visions of Canada as being the "woods" which evokes a frontier pioneer spirit and hominess that has long been lost here in the States. Nobody knows for sure why but we are drawn to Canadians like flies to a fresh steaming pile of dog crap. . In the US we have Soccer Moms but when you hear "Hockey Mom" it conjures images of The All American Mom, mini vans, taking kid to games and play dates, just with a different sport. . Hockey moms apparently drive around in pick up trucks, spend their time putting lipstick on pitbulls and shooting wolves from small airplanes. Not to mention that. hockey is Canada's National sport.
Joe Six Pack is some slanguage I've never heard of. Average Joe, Regular Joe, now Joe the Plumber maybe but Joe Six Pack Never.I've heard from many people who consider themselves to be "average Joe's who were offended to be described as "beer swilling". When you think Joe Six Pack you think of SCTV, the Canadian Comedy show, and the McKenzie brothers, the beer swilling Canadians who sat around in Tooks (Those pointy ski hats) and talked about nothing which featured Canadians Rick Morranis and Dave Thomas.. What American calls a snow mobile a snow machine? What's up with that? When you come down to it, though Sara Palin is an American Girl she just subliminally comes across as Canadian. She was the perfect choice for the Canadian Card. Except for the time spent at 5 different Midwest colleges during her early twenties she has been immersed in Canadian culture her entire life. Remember she grew up in Alaska in the era before Cable and Satellite TV, so Canadian Radio and TV was it. "It was marketing genius," the Republican Media strategist said. "The Campaign took off after her pick." The success of the move was evident within days of the announcement of Sara Palin as the VP choice. Before the Republican convention John McCain couldn't fill a town hall event with a thousand seat capacity. The day after the Republican convention Senator McCain and Governor Palin appeared at a campaign event that had a crowd of over twelve thousand suddenly enthusiastic republicans. Every joint appearance has led to larger and larger crowds. It got to the point that the Pundits began to openly question who had more appeal McCain or Palin.
The McCain Campaign went from 8 points behind Senator Obama to 4 points ahead of him. A 12 point swing in a week."Hockey Moms" for Palin groups sprouted up across the country. To Republicans she has 'good Midwestern" values. A large part of the American public was Dazzled for sure.
Everything was going great, until the Senator was asked a question. Her inability to string together a coherent sentence or even grasp a concept caused Conservative Republicans like George Will, David Brooks, William Kristol and others to question McCains judgement and his fitness to be the President. They all agreed that the Governor is woefully short of the abilities and capabilities we need in the White House at this time. They are in the minority.
The Canada Card worked with the Republican base whose support McCain needs to win the election. The McCain Approval numbers with in the base of the Republicans went from 38% to over 64%. The question to ask will it work with the Independents? Will they be able to see through the Canadian vaneer to the plain old American Politician underneath. The thought on that depends which side of the fence do you think the Independents are on.
Are they thoughtful and taking their time weighing the words and proposed policies of each candidates as some would have you believe. Or are they just stupid? Which, a large number of people think you must be if your still on the fence after an almost 6 year, 2 front war with 5,000 US dead service man and women as well as an economy that is slipping into a severe recession after the greatest economic disaster in US history.
The question is still open. Will Sara Palin turn out to be the next American-Canadian Icon like singer Celine Dion, comedian Jim Carrey and Actor William Shatner, or will she end up like a Brendan Frasier dvd, the latest Gordon Lightfoot or a Gino Vannelli Greatest Hits cd. Consigned to the bargain basement bin of history. Media Savy has always been a strong point of the Carl Rove disciples that McCain brought in to run his campaign. They know how to sell to Americans, after all they got George Bush elected...TWICE. The Canadian Card could potentially be the game changer the McCain campaign is looking for.
"There's still a lot of undecideds out there, " my buddy the Republican media advisor told me with a smile. "If McCain wins this election, blame Canada."

McCain's Ties to Nazi's Neo Nazi's &Terrorists during 80's The McCain campaign is trying to paint Senator Obama as a terrorist sympathizer because of his ties to ex 60's radical William Ayers. How come nobody is talking about McCains time as a board member of the United States Council for World Freedom, the US chapter of the World Anti Communist League. A political organization that included, Fascists, Neo-Nazi's, Terrorists and assorted Right Wing lunatic thugs. While Obama met William Ayers thirty years after his participation in the assorted bombings the Weather Underground Undertook as protests to the US actions in Vietnam in the 60's and early 70's. . John McCain sat on the board of USCWF not only after the organizations ties to a host of Neo Nazi Right Wing Terrorists was exposed but also while UCWF founder retired General John was boasting that WACL was the coordinating body for raising private aid for the Contras for the Reagan White House. A claim backed up by President Reagan's letters praising them for working with the Reagan Administration to aid the Contra's. The World Anti Communist League was started in the Far East by Taiwan and South Koreans united to form a bulwark against communism. One of the biggest monetary supporters was South Korea's Reverend Sun Myung Moon and his vehemently anti communist Unification Church. From the beginning the group had ties to the CIA and US intelligence agencies. WACL and its offshoots all contained current or former politicians, military or intelligence officials from the United States and some of the most repression regimes from all over the world. Members of the Latin American affiliate of WACL, the Latin American Anti-Communist Confederation (CAL) were part of the death squads in El Salvador, Argentina, Guatemala, Paraguay, Chile, Uruguay, Bolivia and Colombia. Members included: Yaroslav Stetsko, a Nazi collaborator who in July 1941 presided over the extermination of 7,000 Jews; Stefano delle Chiaie, a fugitive Italian terrorist wanted for robbery, kidnaping and murder; Mario Sandoval Alarcon, architect of the Guatemalan death squads; Chirila Ciuntu, a Romanian fascistwho participated in a 1941 massacre of Jews; Ray Cline, former deputy directorof the CIA; Jess Helms, Republican Senator from North Carolina; General Jorge Rafael Videla, former Argentine dictator who was imprisoned for mass-murder; and Roger Pearson, a scientific racist whose books on racial superiority are still sold today by American neo-Nazi groups served as WACL President until 1981. How come no one has dared mention John McCain's ties to the United States Council for World Freedom. They are a hell of a lot more damning that Obama's ties to an ex 60's radical thirty years after the fact. When John McCain was palling around with Fascists and Neo Nazi's in the World Anti Communist League, the blood wasn't yet dried on their hands.
