Widows Stunned at Prosecution… Declined Plea Offer in Fragging Case Thursday, February 26, 2009 . Official Portrait of LTG John R. Vines US Army file Photo . First of all I want to let you know how this case came to my attention. . It was from a concerned young lady named Cathy Hughes who sent me the following email… . I am writing to comment on your blog of January 13, 2006, and posted as below:
"Now how can you not help but to like this guy-- Army Lt. General John R. Vines, Commanding General of Multinational Corps Iraq and the 18th Airborne Corps??? Today when he was asked by a reporter about the whereabouts of the enemy forces engaged during last year's fighting in Anbar province... General Vines calmly responded: "Many of them are dead." Keep after them General... Keep after them...... AubreyJ........".
What you may or may not know is that on April 3, 2006, not even six months after this blog, Army Lt. General John R. Vines rejected the guilty plea of Staff Sgt Alberto Martinez in the fragging deaths of Lt Louis Allen and Captain Phillip Esposito, who were killed in Iraq on June 7, 2005. After three and a half years of postponements and other issues, Staff Sgt Alberto Martinez was aquitted of all charges. He was honorably discharged by the Army and now lives as a free man, I am sure with all his benefits in place. Lt Louis Allen and Captain Phillip Esposito left many wives, children, family and friends that are devistated by this outcome. The death certificates of these fine men list their deaths in the Non-Hostile category, which makes them ineligible for the Purple Heart. In addition, Staff Sgt Alberto Martinez repeatedly had threatened Captain Esposito before this current crime was committed, and no mention of this guilty plea was ever mentioned at trial. In fact, the guilty plea offer was signed by Maj. Marc Cipriano and Maj. E. John Gregory, the lawyers for the Martinez. An article in the New York Times noted Army regulations permit them to sign such a plea offer only if they believe the client committed the crime.
The families deserve answers in this case. Lt. Allen and Captain Esposito are not collateral damage. They are not expendable. Neither is anyone else serving our country with honor. They deserve protection from those in the ranks who are devoid of such. I hope and pray that you review your comments and retract them for they condone practices that will keep all of our military in danger.
Sincerely,
Catherine Hughes. I replied with the following email… .
Hello, Cathy…
Thanks for your letter.
Back in 2006, my main and only point in my post was to tell the troops and Lt. General John R. Vines, ‘Job well done in taking the fight to our enemies. How can you not like this guy for that’.
The things you bring up were not in the mix, as far as I knew… and until your letter… this is the first I have ever heard of it.
From everything I’ve heard in the past about Lt. General John R. Vines, he has had nothing but a reputable reputation. But no one is perfect and mistakes are made by everyone. Some much bigger than others…
I can not and will not retract my statements from my 2006 posting. I stand behind them and the troops 1000%. But I will check into the matter you have brought to me and will comment accordingly in a new, future Post.
Bottom line… If the General has done wrong… so be it. I will gladly help you in bringing out the facts.
Thanks again… AubreyJ……… AubreyJ.org. ******************* . After I received Cathy’s email the other day, I asked a few Blogging friends about it and I thank them again for their help in this matter. And as I told Cathy... I would check into the facts in this case... and the following is all I could come up with. . * NewsDay.com had this report on their website Feb. 22nd… It goes in part like this. …The offer was rejected by Lt. Gen. John R. Vines, now retired… Maj. John Benson, a prosecutor in the case who was not involved in the decision to reject the plea offer, says there was concern within the Army that Martinez might have been eligible for parole after 10 years despite having acknowledged murdering two officers… Read this short report at link below… Prosecution declined plea offer in 'fragging' case. * LoHud.com had this report on Feb. 22nd… The widows of two Army officers killed in Iraq more than three years ago say they were not informed that the soldier acquitted in the killing of their husbands had made an earlier offer to plead guilty… Staff Sgt. Alberto Martinez was found not guilty Dec. 4 of two charges of premeditated murder by a military jury after a six-week trial at Fort Bragg, N.C. He was accused of setting off a claymore mine and grenades that killed Capt. Phillip Esposito, 30, of Suffern and 1st Lt. Louis Allen of Milford, Pa., in Tikrit in June 2005… Read the full report at link below… Widows stunned at offer of guilty plea in fragging case.* Here's a few more articles I found on this matter by way of Google Search… > 1st Lt. Lou Allen's kin react to report on fragging case> Army said no to guilty plea > Cleared soldier's guilty plea was rejected> After Guilty Plea Offer, G.I. Cleared of Iraq Deaths. Hopefully by putting this Post up today, some of you will be able to run down some more info for us. . Thanks to all and Kathy too… AubreyJ………

9:01 P.M. EDT
THE PRESIDENT: Good evening. This is an extraordinary period for America's economy. Over the past few weeks, many Americans have felt anxiety about their finances and their future. I understand their worry and their frustration. We've seen triple-digit swings in the stock market. Major financial institutions have teetered on the edge of collapse, and some have failed. As uncertainty has grown, many banks have restricted lending. Credit markets have frozen. And families and businesses have found it harder to borrow money.
We're in the midst of a serious financial crisis, and the federal government is responding with decisive action. We've boosted confidence in money market mutual funds, and acted to prevent major investors from intentionally driving down stocks for their own personal gain.
Most importantly, my administration is working with Congress to address the root cause behind much of the instability in our markets. Financial assets related to home mortgages have lost value during the housing decline. And the banks holding these assets have restricted credit. As a result, our entire economy is in danger. So I've proposed that the federal government reduce the risk posed by these troubled assets, and supply urgently-needed money so banks and other financial institutions can avoid collapse and resume lending.
This rescue effort is not aimed at preserving any individual company or industry -- it is aimed at preserving America's overall economy. It will help American consumers and businesses get credit to meet their daily needs and create jobs. And it will help send a signal to markets around the world that America's financial system is back on track.
I know many Americans have questions tonight: How did we reach this point in our economy? How will the solution I've proposed work? And what does this mean for your financial future? These are good questions, and they deserve clear answers.
First, how did our economy reach this point?
Well, most economists agree that the problems we are witnessing today developed over a long period of time. For more than a decade, a massive amount of money flowed into the United States from investors abroad, because our country is an attractive and secure place to do business. This large influx of money to U.S. banks and financial institutions -- along with low interest rates -- made it easier for Americans to get credit. These developments allowed more families to borrow money for cars and homes and college tuition -- some for the first time. They allowed more entrepreneurs to get loans to start new businesses and create jobs.
Unfortunately, there were also some serious negative consequences, particularly in the housing market. Easy credit -- combined with the faulty assumption that home values would continue to rise -- led to excesses and bad decisions. Many mortgage lenders approved loans for borrowers without carefully examining their ability to pay. Many borrowers took out loans larger than they could afford, assuming that they could sell or refinance their homes at a higher price later on.
Optimism about housing values also led to a boom in home construction. Eventually the number of new houses exceeded the number of people willing to buy them. And with supply exceeding demand, housing prices fell. And this created a problem: Borrowers with adjustable rate mortgages who had been planning to sell or refinance their homes at a higher price were stuck with homes worth less than expected -- along with mortgage payments they could not afford. As a result, many mortgage holders began to default.
These widespread defaults had effects far beyond the housing market. See, in today's mortgage industry, home loans are often packaged together, and converted into financial products called "mortgage-backed securities." These securities were sold to investors around the world. Many investors assumed these securities were trustworthy, and asked few questions about their actual value. Two of the leading purchasers of mortgage-backed securities were Fannie Mae and Freddie Mac. Because these companies were chartered by Congress, many believed they were guaranteed by the federal government. This allowed them to borrow enormous sums of money, fuel the market for questionable investments, and put our financial system at risk.
The decline in the housing market set off a domino effect across our economy. When home values declined, borrowers defaulted on their mortgages, and investors holding mortgage-backed securities began to incur serious losses. Before long, these securities became so unreliable that they were not being bought or sold. Investment banks such as Bear Stearns and Lehman Brothers found themselves saddled with large amounts of assets they could not sell. They ran out of the money needed to meet their immediate obligations. And they faced imminent collapse. Other banks found themselves in severe financial trouble.
These banks began holding on to their money, and lending dried up, and the gears of the American financial system began grinding to a halt.
With the situation becoming more precarious by the day, I faced a choice: To step in with dramatic government action, or to stand back and allow the irresponsible actions of some to undermine the financial security of all.
I'm a strong believer in free enterprise. So my natural instinct is to oppose government intervention. I believe companies that make bad decisions should be allowed to go out of business. Under normal circumstances, I would have followed this course. But these are not normal circumstances. The market is not functioning properly. There's been a widespread loss of confidence. And major sectors of America's financial system are at risk of shutting down.
The government's top economic experts warn that without immediate action by Congress, America could slip into a financial panic, and a distressing scenario would unfold:
More banks could fail, including some in your community. The stock market would drop even more, which would reduce the value of your retirement account. The value of your home could plummet. Foreclosures would rise dramatically. And if you own a business or a farm, you would find it harder and more expensive to get credit. More businesses would close their doors, and millions of Americans could lose their jobs. Even if you have good credit history, it would be more difficult for you to get the loans you need to buy a car or send your children to college. And ultimately, our country could experience a long and painful recession.
Fellow citizens: We must not let this happen. I appreciate the work of leaders from both parties in both houses of Congress to address this problem -- and to make improvements to the proposal my administration sent to them. There is a spirit of cooperation between Democrats and Republicans, and between Congress and this administration. In that spirit, I've invited Senators McCain and Obama to join congressional leaders of both parties at the White House tomorrow to help speed our discussions toward a bipartisan bill.
I know that an economic rescue package will present a tough vote for many members of Congress. It is difficult to pass a bill that commits so much of the taxpayers' hard-earned money. I also understand the frustration of responsible Americans who pay their mortgages on time, file their tax returns every April 15th, and are reluctant to pay the cost of excesses on Wall Street. But given the situation we are facing, not passing a bill now would cost these Americans much more later.
Many Americans are asking: How would a rescue plan work?
After much discussion, there is now widespread agreement on the principles such a plan would include. It would remove the risk posed by the troubled assets -- including mortgage-backed securities -- now clogging the financial system. This would free banks to resume the flow of credit to American families and businesses. Any rescue plan should also be designed to ensure that taxpayers are protected. It should welcome the participation of financial institutions large and small. It should make certain that failed executives do not receive a windfall from your tax dollars. It should establish a bipartisan board to oversee the plan's implementation. And it should be enacted as soon as possible.
In close consultation with Treasury Secretary Hank Paulson, Federal Reserve Chairman Ben Bernanke, and SEC Chairman Chris Cox, I announced a plan on Friday. First, the plan is big enough to solve a serious problem. Under our proposal, the federal government would put up to $700 billion taxpayer dollars on the line to purchase troubled assets that are clogging the financial system. In the short term, this will free up banks to resume the flow of credit to American families and businesses. And this will help our economy grow.
Second, as markets have lost confidence in mortgage-backed securities, their prices have dropped sharply. Yet the value of many of these assets will likely be higher than their current price, because the vast majority of Americans will ultimately pay off their mortgages. The government is the one institution with the patience and resources to buy these assets at their current low prices and hold them until markets return to normal. And when that happens, money will flow back to the Treasury as these assets are sold. And we expect that much, if not all, of the tax dollars we invest will be paid back.
A final question is: What does this mean for your economic future?
The primary steps -- purpose of the steps I have outlined tonight is to safeguard the financial security of American workers and families and small businesses. The federal government also continues to enforce laws and regulations protecting your money. The Treasury Department recently offered government insurance for money market mutual funds. And through the FDIC, every savings account, checking account, and certificate of deposit is insured by the federal government for up to $100,000. The FDIC has been in existence for 75 years, and no one has ever lost a penny on an insured deposit -- and this will not change.
Once this crisis is resolved, there will be time to update our financial regulatory structures. Our 21st century global economy remains regulated largely by outdated 20th century laws. Recently, we've seen how one company can grow so large that its failure jeopardizes the entire financial system.
Earlier this year, Secretary Paulson proposed a blueprint that would modernize our financial regulations. For example, the Federal Reserve would be authorized to take a closer look at the operations of companies across the financial spectrum and ensure that their practices do not threaten overall financial stability. There are other good ideas, and members of Congress should consider them. As they do, they must ensure that efforts to regulate Wall Street do not end up hampering our economy's ability to grow.
In the long run, Americans have good reason to be confident in our economic strength. Despite corrections in the marketplace and instances of abuse, democratic capitalism is the best system ever devised. It has unleashed the talents and the productivity, and entrepreneurial spirit of our citizens. It has made this country the best place in the world to invest and do business. And it gives our economy the flexibility and resilience to absorb shocks, adjust, and bounce back.
Our economy is facing a moment of great challenge. But we've overcome tough challenges before -- and we will overcome this one. I know that Americans sometimes get discouraged by the tone in Washington, and the seemingly endless partisan struggles. Yet history has shown that in times of real trial, elected officials rise to the occasion. And together, we will show the world once again what kind of country America is -- a nation that tackles problems head on, where leaders come together to meet great tests, and where people of every background can work hard, develop their talents, and realize their dreams.
Thank you for listening. May God bless you.

At least make sure to talk with the ones you trust the most on these kinds of matters and proceed accordingly.
These are very serious times we are in right now and there are no guaranties as to how it is all going to work out when the dust clears...

President Bush Presents Medal of Honor to Family of Fallen Army Hero Private First Class Ross Andrew McGinnis Monday, June 02, 2008
About Photo: President George W. Bush leads the applause in honor of Private First Class Ross A. Bush Presents Medal of Honor to Fallen Army Hero's Family
President Bush presented the Medal of Honor to fallen Army hero Spc. Ross A. McGinnis' parents during a White House ceremony here today.
"The Medal of Honor is the nation's highest military distinction; it is given for valor beyond anything that duty could require or a superior could command," Bush said, before presenting the medal to McGinnis' father and mother, Tom and Romayne McGinnis, during the East Room ceremony.
Then- Pfc. McGinnis died at age 19 in northeastern Baghdad on Dec. 4, 2006, while protecting his comrades from an enemy grenade that was thrown into his Humvee. McGinnis, who'd been riding topside in the vehicle's gunner's-hatch opening, dropped down and used his body to absorb the effects of the exploding grenade, thus saving four fellow soldiers.
Presenting the Medal of Honor to McGinnis' parents was "a high privilege," Bush said, noting McGinnis was a selfless hero who could easily have jumped off the vehicle and saved himself.
"Instead, he dropped inside, put himself against the grenade and absorbed the blast with his own body," Bush said. "In that split-second decision, Private McGinnis lost his own life and he saved his comrades."
McGinnis' surviving comrades, Sgt. 1st Class Cedric Thomas, Staff Sgt. Ian Newland, Sgt. Lyle Buehler, and Spc. Sean Lawson, as well as some prior Medal of Honor recipients, also attended the ceremony.
Thomas has noted that McGinnis had plenty of time to avoid the exploding grenade, the president said, but instead chose to save his buddies.
"America will never forget those who came forward to bear the battle," Bush vowed. "America will always honor the name of this brave soldier, who gave all for his country."
McGinnis enlisted in the Army at age 17 on June 14, 2004. At the time of his death, McGinnis was assigned to the 1st Infantry Division's 1st Battalion, 26th Infantry Regiment, 2nd Brigade Combat Team, in Schweinfurt, Germany. He was promoted to specialist posthumously.
McGinnis' family received their son's Silver Star and Purple Heart medals in December 2006 at a memorial service held in their hometown of Knox, Pa., about 60 miles northeast of Pittsburgh.

The following is a post I put up on my main Blog a few weeks back...
Exaggerated Environmental Fears, Strong Prejudice against Oil Companies and Sheer Stupidity by many in Congress Put Large Areas of Potential U.S. Oil/Gas Supplies TOTALLY Off-Limits Wednesday, April 30, 2008 WashingtonPost.com has this article today by Op-Ed Columnist Robert J. Samuelson and it goes in part like this... It may surprise Americans to discover that the United States is the third-largest oil producer, behind Saudi Arabia and Russia. We could be producing more, but Congress has put large areas of potential supply off-limits. These include the Atlantic and Pacific coasts and parts of Alaska and the Gulf of Mexico. By government estimates, these areas may contain 25 billion to 30 billion barrels of oil (against about 30 billion barrels of proven U.S. reserves today) and 80 trillion cubic feet or more of natural gas (compared with about 200 tcf of proven reserves.) Read this article in full at link below...

...
* FT.com reports this troubling news... OPEC's President on Monday warned that oil prices could hit $200 a barrel and there would be little the cartel could do to help... Read the rest at link below...
...
* President Bush had a few things to say about this yesterday during a Press Conference in the Rose Garden. Some of his comments went like this...
...I've repeatedly submitted proposals to help address these problems. Yet time after time, Congress chose to block them. One of the main reasons for high gas prices is that global oil production is not keeping up with growing demand. Members of Congress have been vocal about foreign governments increasing their oil production; yet Congress has been just as vocal in opposition to efforts to expand our production here at home.
They repeatedly blocked environmentally safe exploration in ANWR. The Department of Energy estimates that ANWR could allow America to produce about a million additional barrels of oil every day, which translates to about 27 millions of gallons of gasoline and diesel every day. That would be about a 20-percent increase of oil -- crude oil production over U.S. levels, and it would likely mean lower gas prices. And yet such efforts to explore in ANWR have been consistently blocked.
Another reason for high gas prices is the lack of refining capacity. It's been more than 30 years since America built its last new refinery. Yet in this area, too, Congress has repeatedly blocked efforts to expand capacity and build more refineries.
As electricity prices rise, Congress continues to block provisions needed to increase domestic electricity production by expanding the use of clean, safe nuclear power. Instead, many of the same people in Congress who complain about high energy costs support legislation that would make energy even more expensive for our consumers and small businesses.
Congress is considering bills to raise taxes on domestic energy production, impose new and costly mandates on producers, and demand dramatic emissions cuts that would shut down coal plants, and increase reliance on expensive natural gas. That would drive up prices even further. The cost of these actions would be passed on to consumers in the form of even higher prices at the pump and even bigger electric bills.
. Instead of increasing costs and increasing new roadblocks to domestic energy production, Congress needs to clear away obstacles to more affordable, more reliable energy here at home... Read the full transcript HERE

My take is this... * VOTE DBD for a Better Tomorrow * DRILL Wells... BUILD new Refineries/Plants... and DEVELOP New Technologies for a better, Energy Independent, Tomorrow.
...
.Come ON America!!! We GOT to stop all this in-house fighting on who has the best ideas on Energy Policy and start spreading out an umbrella of all workable ideas that will fix our energy problems TODAY and in the near/long-term future!
Everytime you drive by a gas station and see those out of sight gas prices, remember this... Talk-- talk-- talk... and NO ACTION... is NOT CHEAP! We got to start Drilling, Building and Developing new... clean technologies!!!
Like me... have you noticed that we are now starting to pay dearly for everything from gas at the pumps down to the food on our tables... all because of talk, but never any action out of congress over these last few decades...?
Both parties can find fault within... So stop pointing fingers at each other and start working together and finally get some really good laws past to help bring these crazy prices back down to something we can all live with.
I'll say it again- America... VOTE DBD for a Better Tomorrow
Demand It!!! Your Wallet/Purse depends on it.

The American people deserve the truth from their leaders. Doing the right thing in the heat of a political campaign is not always the easiest thing. But when 4,000 Americans have given their lives so that America does not suffer the worst consequences of our failure in Iraq, it is a necessary thing. In such a grave matter, we must put the nation's interests before our own ambitions.
My opponents' calls for an immediate withdrawal, regardless of the consequences, is a reckless and dangerous move that would threaten the long term security of our country. Leadership is not about bowing to the political pressures, it is about thinking through the consequences and having the experience and judgment to make the tough decisions.
Senators Clinton and Obama will surely echo the sentiments of their extreme liberal supporters and call for a pre-emptive withdrawal from Iraq. The American people deserve better. I encourage both candidates to move beyond empty and destructive rhetoric and elevate the debate to a level that the country deserves. There are tough decisions ahead and America deserves leaders that are up to the challenge.
As president, I will ensure that our troops come home victorious in this war that is part of the larger struggle against radical Islamic extremism and will continue to make keeping our nation secure my highest priority.
