Terms and Conditions

Entry into the competition is deemed acceptance of these terms and conditions.

Promotion commences on 09/09/2009 at 00:01 AEST and closes 30/09/2009 at 23:59 AEST. The promotion is open to all residents of Victoria.
The Promoter is Beam Global Australia Pty Ltd (85 003 953 357) of Level 2, 49 Frenchs Forest Rd, Frenchs Forest NSW (“Promoter”).
Employees, officers and their immediate families of the Promoter, its agencies and the participating outlets associated with this promotion including the Esplanade Hotel, Coca-Cola Amatil (Aust) Pty Ltd and Beam Global Australia Pty Ltd are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
To be eligible to win, entrants are required to purchase a Jim Beam variety 330ml or 375ml RTD product from The Esplanade Hotel and SMS the barcode on the product purchased to 199 55 444 during the promotional period along with their full name and address. One entry per barcode is permitted. Entries will only be accepted if the barcode is from a product purchased at The Esplanade Hotel.
SMS cost is $0.55 per message including GST.
Entrants must have access to an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. Consumers should check with their network service provider to see if their mobile phone is able to send an SMS to the promotional number.

Persons under 18 years of age cannot enter the competition.

Winners will be notified by phone on the mobile number which their entry was submitted from and in writing to their provided address.
The major prize winner must be able to take prize on 15/10/2009 to the 19/10/2009 inclusive.
The first (1) valid entry drawn will win the following prize: 2 x return economy class flights from Melbourne to Perth departing on the 15^thand returning on the 19^th of October, 4 x nights twin share accommodation in a 4–star apartment hotel and 2 x delegate passes to the One Movement Festival held 16^th-18^th October in Perth City. The prize is valued at $4800.00. The winner must pay all extra associated costs with claiming the prize – including but not limited to: transport to and from airport’s to home / accommodation, food, refreshments, mini-bar in hotel, drinks, transport to and from One Movement to accommodation.
30 runner-up winners, will each receive a runner up prize of a Jim Beam The Label Behind live Music merchandise pack including 1x T-Shirt, 1 x Stubbie Cooler, 1 x lanyard, 1 x drawstring bag. Each runner up prize pack is valued at RRP $60.00 including GST
The total prize value is $6600.00 including GST

The major prize and runner-up prize draws will take place at 12:00 midday on the 1^st of October 2009 at 5^th Finger, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW, 2000. The Promoter’s decision is final and no correspondence will be entered into. Prize Draw winners will be notified by phone on the mobile number which their entry was submitted from and in writing to their specified address via express post.
Competition winners will be listed in the Australian Newspaper on Thursday 8^th October 2009.
If the major prize should not be claimed by the major prize winner by 5:30pm on Friday 9^th October 2009, the major prize will be transferred to the first runner-up winner drawn.

In the event that the major prize will be transferred to the first runner-up winner, the competition winners will be listed in the Australian Newspaper on Thursday 15^th October 2009.
The prize is not transferable, divisible or exchangeable and cannot be redeemed for cash. The Promoter reserves the right to supply an alternative prize of similar value.
Entries are deemed to be received at the time of receipt into the Promoter’s database, not time of transmission by the entrant. In the event of a dispute regarding a prize awarded to an SMS entry, the prize will be awarded to the owner of the relevant mobile phone number.
The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, or otherwise, (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise).
No responsibility accepted for late, lost or misdirected entries. Incomplete and incomprehensible entries and entries with defamatory or offensive content or incorrect contact details are not eligible to win.

The use of any automated entry software or any other mechanical or electronic means that allows an entrant to enter is prohibited and will render all entries submitted by that entrant invalid.

Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry process in any way, or who does not properly comply with the entry process, will be ineligible to win.

If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition.

The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law.
All entries become the property of the Promoter. By entering the competition entrants understand and agree that the Promoter (and its affiliates and companies that work for the Promoter) may use and disclose the information provided by them by entering the information into a database for future promotional, marketing or publicity purposes, subject to any applicable privacy laws.
The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
