WASHINGTON (AFP) - US President George W. Bush plans to veto legislation passed by the Senate to bar the CIA from using harsh interrogation methods including waterboarding, a spokeswoman said Thursday.


"The president will veto that bill," said White House spokeswoman Dana Perino.

"The United States needs the ability to interrogate effectively, within the law, captured Al-Qaeda terrorists."

The Democratic-led Senate voted 51-45 on Wednesday in favor of a bill calling for the Central Intelligence Agency to adopt the US Army Field Manual, which forbids waterboarding and other types of coercive interrogation methods.

However, the vote fell short of the two-thirds majority needed to overcome a presidential veto. The House of Representatives passed similar legislation in December.

Democratic New York Senator Charles Schumer said that if Bush "vetoes intelligence authorization, he will be voting in favor of waterboarding."

Asked by a reporter if Bush, who leaves office in 2009, would be labeled as the first US president who favored torture, Perino rejected the assertion and dismissed Schumer's argument as "simplistic."

"Across the board people will see, over time, that this was a president who put in place tools to protect the country against terrorists," Perino said.

"The president does not favor torture. The president favors making sure we do all these programs within the law," she said, adding that "all the interrogations that have taken place in this country have been done in a legal way."

Perino said the United States does not currently use waterboarding, a simulated drowning technique denounced by rights groups as torture, even though the CIA has admitted using the technique in the past.

She reiterated the administration's assertion last week that it would not rule out the use of such techniques in the future.

"Currently under the law it is not (allowed)," she said. "As we said last week as well, we are not going to talk about what may or may not be lawful in the future."

The Senate bill would limit the CIA and other intelligence agencies to the 19 interrogation techniques outlined in the military's manual. Waterboarding is not among them.

Perino said the intelligence community's view is that the Army Field Manual sets an inappropriate standard for seasoned CIA interrogators who are working to extract information from sophisticated militant operatives.

"Today with this bill that they are sending to us they would basically repeal the terrorist interrogation program in favor of something that will definitely weaken our ability to protect the country," Perino said.

"This Army Field Manual is something that is public for all to see, and we know that Al-Qaeda trains to resist interrogation techniques such as those."

Rival Democratic White House hopefuls Senators Hillary Clinton and Barack Obama were on the road campaigning and did not take part in the vote Wednesday.

The likely Republican nominee, Arizona Senator John McCain, voted against the bill. The former prisoner of war however said that his vote was consistent with his anti-torture stance.

"We always supported allowing the CIA to use extra measures," he said. "I believe waterboarding is illegal and should be banned," McCain said.

Pentagon alters homosexuality guidelines

WASHINGTON - Pentagon guidelines that classified homosexuality as a mental disorder now put it among a list of conditions or "circumstances" that range from bed-wetting to fear of flying.

The new rules are related to the military's retirement practices. The change does not affect the "don't ask, don't tell" policy that prohibits officials from inquiring about the sex lives of service members and requires discharges of those who openly acknowledge being gay.

The revision came in response to criticism this year when it was discovered that the guidelines listed homosexuality alongside mental retardation and personality disorders.

Mental health professionals said Thursday they were not satisfied by the change.

"We appreciate your good-faith effort to address our concern that the document was not medically accurate," James H. Scully, head of the American Psychiatric Association, wrote David Chu, undersecretary of defense for personnel and readiness. "But we remain concerned because we believe that the revised document lacks the clarity necessary to resolve the issue."

The guidelines outline retirement or other discharge policies for service members with physical disabilities. The rules include sections that describes other specific conditions, circumstances and defects that also could lead to retirement, but are not physical disabilities.

Among the conditions are stammering or stuttering, dyslexia, sleepwalking, motion sickness, obesity, insect venom allergies and homosexuality.

"More than 30 years after the mental health community declassified homosexuality as a mental disorder, it is disappointing that the Pentagon still continues to mischaracterize it as a 'defect,' said Rep. Marty Meehan (news, bio, voting record), D-Mass., a member of the House Armed Services Committee.

Pentagon spokeswoman Cynthia Smith said "homosexuality should not have been characterized as a mental disorder. A clarification has been issued."

The psychiatric association declassified homosexuality as a mental disorder in 1973. Questions about the Pentagon's guidelines were raised in June by a research institute at the University of California at Santa Barbara.

There were 726 military members discharged under the "don't ask, don't tell" policy during the budget year that ended Sept. 30.

Few Americans favor abstinence-only sex education

NEW YORK (Reuters Health) - Most Americans, regardless of their political leanings, favor comprehensive sex education in schools over abstinence-only programs, researchers reported Monday.

Currently, the federal government champions the abstinence-only approach, giving around $170 million each year to states and community groups to teach just-say-no sex education. This funding precludes mention of birth control and condoms, unless it's to emphasize their failure rates.

However, critics point out that studies have failed to show that abstinence-only education delays sex or lowers rates of teen pregnancy.

This latest study, according to the authors, suggests that the federal government is out of step not only with research, but also with public opinion.

Of the nearly 1,110 U.S. adults they surveyed, 82 percent supported programs that discuss abstinence as well as other methods for preventing pregnancy and sexually transmitted diseases. Half were in outright opposition to abstinence-only education.

Even among self-described conservatives, 70 percent supported comprehensive sex ed., while 40 percent opposed the abstinence-only strategy.

The findings "highlight a gap between policy, and science and public opinion," said Dr. Amy Bleakley of the University of Pennsylvania in Philadelphia and lead author of the new study.

Whether this divide will influence policy-makers is unknown, she told Reuters Health. "We just want to bring this to their attention," she said.

Bleakley and her colleagues report the findings in the Archives of Pediatrics & Adolescent Medicine.

To receive federal funding, abstinence-only programs must meet eight criteria set down in 1996. Among these is the stipulation that abstinence until marriage be taught as the "expected standard of human sexual activity."

Only a handful of studies have examined the effectiveness of such programs, and the results have been mixed, according to an editorial published with the study.

Many more studies have looked at comprehensive sex ed. and found that some programs do increase condom and contraceptive use, but may also help delay sex, writes Dr. Douglas Kirby of ETR Associates in Scotts Valley, California.

ETR Associates is a non-profit company that researches and develops health programs, including STD and pregnancy prevention programs for schools.

"Until we have strong evidence that particular abstinence-only programs are effective," Kirby argues, "we certainly should relax the funding restrictions and fund programs (including comprehensive programs) that effectively delay sex among young people."

Bleakley agreed with that conclusion. But beyond the issue of balance in funding, she said, is the fact that there is evidence comprehensive sex education can help prevent the potential consequences of teen sex -- including HIV and other STDs.

Evangelist admits meth, massage, no sex

COLORADO SPRINGS, Colo. - Evangelist Ted Haggard admitted Friday that he bought methamphetamine and received a massage from a gay prostitute who claims he was paid for drug-fueled trysts by the outspoken gay marriage opponent.

Haggard resigned Thursday as president of the National Association of Evangelicals and stepped down as leader of his Colorado megachurch while the two groups investigate the allegations.

Talking to reporters outside his house Friday, Haggard denied the sex allegations but said that he did buy meth from the man because he was curious.

"I bought it for myself but never used it," he said. "I was tempted, but I never used it."

Haggard, a married father of five, said he never had sex with Mike Jones, a 49-year-old male prostitute who sparked the scandal when he told a radio station he had had a three-year sexual relationship with the minister. He said he did get a massage from Jones after being referred to him by a Denver hotel.

Haggard resigned as president of the 30 million-member association Thursday and stepped down as the leader of the New Life Church pending investigations into Jones' claims.

The executive committee of the National Association of Evangelicals, which claims 30 million members, planned a conference call Friday and said it would release a statement afterward.

The acting pastor of Haggard's New Life Church, Ross Parsley, told congregants in an e-mail that the church's four-member board of overseers had met with Haggard on Thursday.

"It is important for you to know that he confessed to the overseers that some of the accusations against him are true. He has willingly and humbly submitted to the authority of the board of overseers, and will remain on administrative leave during the course of the investigation," the e-mail stated.

The scandal hit as voters in Colorado and seven other states are getting ready to decide Tuesday on amendments banning gay marriage. Besides the proposed ban on the Colorado ballot, a separate measure would establish the legality of domestic partnerships providing same-sex couples with many of the rights of married couples.

Members of Haggard's 14,000-member megachurch were stunned.

"It's political, right before the elections," said Brian Boals, a New Life member for 17 years.

Church member E.J. Cox, 25, called the claims "ridiculous."

"People are always saying stuff about Pastor Ted," she said. "You just sort of blow it off. He's just like anyone else in the public eye."

Jones said he decided to go public because he was also upset when he discovered Haggard and the New Life Church had publicly opposed same-sex marriage.

"It made me angry that here's someone preaching about gay marriage and going behind the scenes having gay sex," he said.

"I just want people to step back and take a look and say, 'Look, we're all sinners, we all have faults, but if two people want to get married, just let them, and let them have a happy life,'" said Jones, who added that he isn't working for any political group.

Jones claimed that Haggard, 50, paid him to have sex nearly every month over three years. He said he advertised himself as an escort on the Internet and was contacted by a man who called himself Art, who snorted methamphetamine before their sexual encounters to heighten his experience.

Jones said he later saw the man on television identified as Haggard and that the two last had sex in August.

He said he has voice mail messages from Haggard, as well as an envelope he said Haggard used to mail him cash. He declined to make the voice mails available to the AP, but KUSA-TV reported what it said were excerpts late Thursday that referred to methamphetamine.

"Hi Mike, this is Art," one call began, according to the station. "Hey, I was just calling to see if we could get any more. Either $100 or $200 supply."

A second message, left a few hours later, began: "Hi Mike, this is Art, I am here in Denver and sorry that I missed you. But as I said, if you want to go ahead and get the stuff, then that would be great. And I'll get it sometime next week or the week after or whenever."

Haggard was appointed president of the evangelicals association in March 2003. He has participated in conservative Christian leaders' conference calls with White House staffers and lobbied members of Congress last year on U.S. Supreme Court appointees after Sandra Day O'Connor announced her retirement.

After Massachusetts legalized gay marriage in 2004, Haggard and others began organizing state-by-state opposition. Last year, Haggard and officials from the nearby Christian ministry Focus on the Family announced plans to push Colorado's gay marriage ban for the 2006 ballot.

At the time, Haggard said that he believed marriage is a union between a man and woman rooted in centuries of tradition, and that research shows it's the best family unit for children.
