Listener survey 115 is underway so click here and tell us what you think.  Rate new songs from Feist, The Eagles, Mike Doughty, Foo Fighters and more. We have new survey songs and questions every two weeks, so music fans of music city speak up and help us make Lightning 100 what you want it to be.

The Red Hot Chili Peppers have sued Showtime Networks Inc. as well as the creator and executive producer of the series Californication over the title of the show. The band claims unfair use of its intellectual property, as Californication was the title of their smash 1999 album as well as one of the hit singles off the record. The lawsuit claims the term is "inherently distinctive, famous and has been the subject of substantial advertising and promotion, has been used and advertised throughout the United States and the world, is widely recognized... and immediately associated in the mind of the consumer and those in the trade" with the Chili Peppers.

"The Red Hot Chili Peppers would never have allowed their iconic album and song title to be used as the title of a television program -- much less this one," said the band's legal council, Justin Ehrlich. "They are particularly offended that Showtime used its material without permission."

The lawsuit, filed in Los Angeles Superior Court, alleges "unfair competition, dilution of the value of the 'Californication' mark and unjust enrichment." The band is seeking permanent injunction barring Showtime and other defendants from using the title Californication "or any confusingly similar title" for the TV show. The suit also asks for "actual damages; treble damages; restitution and disgorgement of all profits; and punitive damages."

Singer Anthony Kiedis stated, "Californication is the signature CD, video and song of the band's career, and for some TV show to come along and steal our identity is not right."

The series, starring David Duchovny, debuted over the summer. E! Online reports that the show's creator, Tom Kapinos, claims he first heard the term in the 1970s on a bumper sticker that read "Don't Californicate Oregon." However, E! also notes that the show has deliberately referenced the Chilis, with a character nicknamed "Dani California" and another episode quoting the lyrics to the song "Californication."

While there has been much speculation on the results of Radiohead's sales experiment surrounding their new album, In Rainbows, no official data had been released until this week. Research firm ComScore Inc. says that with fans given the option to pay whatever they wanted for the digital-only release of In Rainbows, the majority of them chose to pay nothing.

According to ComScore's data, less than four out of 10 fans who globally downloaded In Rainbows paid nothing for it. Those who did pay spent an average of $6.00.

In the U.S., the percentage was slightly higher, with 40 percent of downloaders paying for In Rainbows, with an average price of $8.05. In countries outside the U.S., 36 percent paid an average of $4.64.

ComScore analyst Andrew Lipsman told Bloomberg, "There's more of a download culture in Western Europe, so maybe these are people more used to not paying. Or the other theory is that the U.S. has higher disposable income on average than the rest of the world."

In Rainbows will be released on CD internationally by XL Recordings, but a date has yet to be announced. Yesterday the band announced that they would release a box set online of their pre-2007 catalog in conjunction with their former U.K. label home, Parlophone.
