]] ladies and gentleman, in the spirit of mimicking oppressive "intellectual property" laws now instituted by the recording industry in the United States, i now announce that from this moment forward i will no longer utilize my singing and or voice in any way shape or form in subsequent Flight Orchestra recordings.... also, i can do without being compared to Thom Yorke over and over again, rather than being recognized as my own unique voice.....i guess it costs more to be considered unique by the press.....ask Lady Gaga.... Thom Yorke is a simple comparison and frankly i dont feel like i can improve on it... so thank your indie press for that.

What is ownership, in terms of the internet? How does this affect artists in the long run? Well, there are several schools of thought at this point, lets briefly examine a few, particularly pertaining to data, software, hardware, and internet infrastructure. There is the open source culture, that believes in sharing of knowledge and ideas to create a product that is superior because there are more minds and more influences attributing to the product itself. Ownership, in this sense, I believe is less tactile and more truly artistic, in that one can use a product developed by open source methodology to his or her specific advantage, even improving upon the product to fit their specific needs and benefits, then sharing this with a group to be expanded upon. This can be considered a scientific approach to developing because things can be openly proven or disproved , used and abandoned, improved and customized endlessly. The mainstay of the open source culture is free and unlegislated sharing of knowledge, software, and ideas with the aim of creating a supremely well rounded and customizable product. HOWEVER, the doorway into this culture I believe is KNOWLEDGE, and that to participate in this culture in whatever context, you need place aside a few entrenched ideals, especially if you are an American. Another ownership ideology is that of the civilized internet, such as the one current French President Nicolas Sarkozy seeks to create within France. This "civilized" internet aims to put ownership and legislative rights in the hands of internet service providing companies and law enforcement officials, to create regulations and laws targeting "pirates" of digital copyrighted material such as movies, video games, music, television shows and digital medium. Sarkozy presents a three strikes law, in which internet service providers are given the legislative jurisdiction to terminate software "pirates" internet service accounts if they are found guilty of exchanging, hosting, or downloading copyrighted material. Now, we can examine this law and see the reasoning behind it and agree in some aspects. But is Sarkozy protecting products, or knowledge? A major point of contention with persons who have any kind of education about the internet is that, the INTERNET IS NOT A PRODUCT TO BE GOVERNED by anyone, internet service provider, government, or ANY type of business. The internet, was invented and developed at universities as essentially an educational and scientific tool during the 1960s. To govern the internet with legislation or ideology that blankets it as a commodity is EXTREMELY worrisome, and something that anyone who uses the internet (which is everyone) should take deep concern over. So, Nicolas Sarkozy which came first? The internet, or digital file compression? What comes next? Continued open source internet development, or a banishment of creative ideals by legislation that protects business, even if those open source creative ideals have benefited the entire world? Depending on your morals, ethics, and education, I'm sure you are shouting your response to your computer screen as you read! Lets move onto another aspect of digital ownership, that of hardware. We can tie this ownership aspect into the discussion of Nicolas Sarkozys' ideal, in creating the association between an internet service providers ownership of the hardware and telecommunications infrastructure, and their belief in the right to be able to govern that domain. Again, if one looks at this situation objectively one can see the reasoning behind creating and legislating a "civilized internet". But this ideal begs the question, which came first, the internet, or internet service providers? Who developed things first and what ideal was used? The answers to that are very clear and undeniable. Another ownership aspect is that of companies such as Nintendo and Apple. Who have brilliantly used their ownership and development of hardware to protect their ownership of a digital medium. If you examine briefly each of these companies latest products, the Nintendo Wii and Apple Itunes respectively, you get a sense of how these companies protect and own their digital products. This protection comes in the sense that they individually own the rights, software, and knowledge base related to the hardware that presents and operates their products. These companies protect that ownership very aggressively. So, this said, where does this leave us, the artist? Slave to hardware? Slave to ownership? Slave to copyright? These are strong words, but a case can be made towards the fact that copyrights, hardware, and infrastructure ownership are currently left in the hands of entities or governments that CAN AFFORD those rights, and afford the development towards achieving a product. Where does that leave me and you? Most of us, unfortunately, are not in the tax bracket to be able to afford a software or hardware development team. Today, I announce my small step to advocate an advancement in American creative ideology, that of a more open sourced approach. Beginning next year, I will operate a non-profit organization and will allot a once a year , $2500 award to one artist, band, unclassifiable artist , or collective that I see potential in advancing an open source creative and developmental philosophy. The artist or collective that receives this endowment will be expected to post their creative output on the internet by way of a website that I will provide, allow for free or pay as you like download-ability, and to share and document their creative processes, opinions, triumphs, failures, and results. I seek to bring awareness and acceptance of this process, and to prove that within this process a superior artistic product can be achieved, by individuals or entities that are not creating with a marketing angle, or being sponsored, or legislated by major corporations, or government entities. This morning, not feeling particularly well, I decided to brave the rain and jaunt to my local market for some comfort food and electrolyte stocked beverages. The weather accommodated me very well, rainy, humid, a bit cold a bit hot. Or, that could be my body temperature talking. As I came to a busy intersection that preceded my places of capitalistic interest (guarded by socialists selling newspapers), I came upon a woman, a bit shorter than me, middle aged, white hair, glasses, very resolute, holding a NO on Prop. 8 sign, dripping rain water from its edges. Previous to her, I had passed a group of younger, much hipper looking men, standing under cover from rain, holding the same signs and inspiring drivers who were coming off the 580 freeway to honk in support of voting no on Proposition 8. It was a very , very loud intersection.The woman dutifully approached me as I was waiting for the little white, LCD man to tell me to walk safely across the street."Are you registered to vote?" she asked, huskily. "I sure am." I was sweating, I had a fever. I had a hair cut yesterday so I was a bit shy.She excitedly bounced her NO on Proposition 8 sign above her head and offered a suggestive, poignant grin towards me. I smiled in turn and gave this repose:"You know, I can understand both sides, why someone would vote yes, and why someone would vote no."Hoping that would inspire a conversation….She pondered , " I've had many , many interesting conversations today, especially with those who are voting yes. But the one thing that I have been getting a lot of today is respect, from both sides. And that's the way you make change, by letting the other side see your point and considering it. That's the only way."We continued a pleasant conversation, the white LCD man gave me the all clear, I patted the woman on the back and told her to keep fighting the good fight. A bit later, I passed the same busy intersection, shopping bags in hand, umbrella over my head to find a slight, middle aged man, wearing an army bomber jacket, functional practical brown shoes, average jeans, and bouncing a No on Proposition 8 sign slowly above his head. Drivers echoed past him, some honking, most ignoring. He was alone, clothes soaking wet, large umbrella glistening over his head. Standing quietly.I stood about ten feet away from him for about 3 minutes, again waiting for my friend mister white LCD man to tell me to safely walk. But, I felt his pride, I felt his belief. And, I actually considered giving him some of the raspberry fruit tape that I guard with my life. But, I moved quickly on as the rain had intensified and I was sweating. I walked toward my neighborhood...My experience this morning aside, consider this.The fundamentalism that supports proposition 8 is religious. Defining marriage as a union between a man and a woman has its roots in religion. You cannot argue this fact.When you see PROTECT OUR CONSTITUTION VOTE NO ON PROPOSITION 8, this is a very accurate statement. I think the forefathers of this country had in mind the FREEDOM to practice any religion we wish. NOT TO BE GOVERNED OR MANDATED BY ANY RELIGION. You can make a case that this is the very reason a group of English renegades sailed across a vast ocean to colonize uncharted (or previously believed to be uncharted) land. I respect you if you are a person of faith. But I ask you to consider this when you cast your vote in regards to Prop 8.Today, you can walk down the street and encounter a homosexual person who respects your opinion on why you feel your belief should directly affect and complicate their lives.The point being is today,YOU CAN PHYSICALLY INTERACT with a homosexual person, group, or couple.If you believe that your vote for Prop 8 "protects" marriage, consider the HUMANS that your vote would directly affect.Also consider, that you are voting on a proposition that has its roots in ancient PHILOSOPHY, penned and rewritten over EONS of time to suit culture, and instill fear upon commoners. Sound familiar? (paging George W Bush)Again, very clearly, I respect your religious beliefs. But I can call my gay friends right now, sit down to a cup of coffee with them, and talk about how I will vote regarding all of the California Propositions. Unfortunately and regrettably, I cannot do the same with Jesus Christ, Allah, or any deity.

Musicians - We have sold our soul to rock and roll, lock , stock, and barrel.
We have done everything in our power to be noticed.
We've lived the lifestyle. We've sneered at all the right things. We made all the right friends. We've gone to all the right parties. We've met and fucked all the right people. We've gotten 10,000 MySpace plays to generate that "internet buzz". We've gone on tour and spent our own money in hopes of reaching new audiences. We've paid a publicist. We emulate Radiohead, the last "real" band on the planet. We signed a managerial contract to a manger or management company with "connections". We've made music that sounded like the eighties even though we've probably only just lived in them as snot nosed youths, or in some cases not at all. We feigned interest in bands who look and sound like the eighties that we read about in major music publications, so we can have an "educated" music conversation. We tried out for a reality TV show. We dreamed. We waited. We prayed. We hoped. We played Guitar Hero and/or Rock Band perhaps a little too vicariously. ……..then reality set in.
We've frowned after pouring our lives into something with no support, from anyone. We've walked alone when family, significant others , friends and band members told you to give up. We've felt disappointed when those who stood, and stand behind us for so long see no fruit from our labors. We've scowled when the record "industry" shrunk into nothing more than a licensing one stop house for television and film, not interested in anything new or challenging, because everyone knows that "middle America" doesn't buy that shit, even if it is good (see the Flaming Lips). We blamed Napster, Lime Wire or any bit torrent site though we all use them to grab anything digital we wish. We flip flopped, one day believing in Chuck D when he said fight the power, the next day siding with Lars Ulrich in decrying file sharing. We cowered when the United States government OUTLAWED art when it ruled against creative sampling. We furrowed our brow at Girl Talk and Dangermouse when, with the proper financial backing, they were able to completely disregard those laws and sell records and become "pop" stars and "rebels". We've become legislated, frustrated, humbled, and totally lost.
Give up musicians, its over, the game is up. Everyone knows that rock and roll was perfect in 1973 when Pink Floyd released Dark Side of the Moon. Marketing was perfect, the product was perfect, the audience was perfect. Everyone , and everything else since has been an imposter, yes even Radiohead.

What next?
What IS next for musicians who refuse to adhere to the Jonas Brothers, Lindsay Lohan , Bret Michaels , Disney Channel , Viacom formula?
What of musicians who refuse to be Fallout Boy , Panic at the Disco , Evanescence , Kate Perry , or Radiohead who fall in to the MTV formula of bands that are JUST controversial enough to be noticed and played on NPR. Because everyone knows that NPR is the only liberal media outlet and true artistic justification as an artist in the United States.
Where do we go next? And how do we AFFORD to be different?
The first obvious answer is to unionize. Plain and simple. The way to garner power from those who OWN power is to unionize. And of course, an ineffectual musicians union , the American Federation of Musicians, already happily exists. Whose current stances among others are to seek a ban on "virtual" orchestras to "protect" musicians, and being a front line participant in support of anti-sampling legislation, along with the RIAA (Recording Industry Association of America). This is certainly protecting musicians everywhere! It would seem that these entities seek to protect those who have something to protect.
The next answer of course is to look towards the local level, start club nights and perpetuate new and interesting sounds.
Every major city has a music "scene" where an amalgam of people called "hipsters" ask a bar, club, or art gallery to host an event, probably bi-monthly, invite all their cool looking friends, take pictures, pay too much for drinks and create malarkey worthy of posting on our MySpace or Facebook accounts.
All fine, and fun, and good in my opinion. But does that feed the artist or organizer in the long run? More often than not, the OWNER of the venue takes the largest cut of profits from the bar, while musicians and organizers are left to scrape together what comes IN the door. From personal experience, it is far more difficult to convince people to come to an event where the only draw is that they will hear something new and interesting. Granted, and again from personal experience, success can be attained but there is a HUGE amount of thankless, personal, emotional and financially costly effort that goes behind that success. In most instances as a promoter, admission is left free of charge just to get people in the venue so the OWNERS can make a profit from overpriced drinks and malarkey enabling.
Again, musicians , HUGE disadvantage. Expendable. Are we starting to see a pattern here?
Then there is the "real world". Or, those who are fortunate enough to get a job as a musician, artist, or creative person in today's American economic culture.
Rather than presenting my own opinion in this regard I seek only to ask these questions to those who hold those creative jobs. And I preface this by stating that, of course, I am aware of exceptions:
When does the roll of an artist in our American culture become relegated ONLY to advertising?
How many of you are able to make a living doing or selling EXACTLY what you want?
How many of you, within your creative job are able to say EXACTLY what you want through your art, when you want to?
How many of you would rather say something honest about your product, rather than conforming to a company policy, for fear of losing a job you've competed for, had years of college training for, or exercised a favor to reach that position?
In truth, these are very idealistic questions. But each I believe inspires a very true, unbiased answer depending on your morals and ethics. And in answering these questions, where does that leave room to ADVANCE art? More often than not, the answers at this point are pretty bleak. So, where do we go next?
Current unions for musicians in the United States do not work because they are adhering to Sinatra-era ideals, protecting companies and musicians who have everything to lose and seek nothing to gain but profits. They seek to maintain some kind , ANY kind of control. Desperately I may add…
They need PROTECTION from the future.
Local level organizing is all well and fine. But anyone who has put an event together knows, its no way to make a steady living unless you have CAPITAL, or some kind of financial safety net (IE a day job , trust fund or something to that effect) to back you up.
I will not sit here and insult your intelligence by proposing that musicians or artists who have been left out, or left behind by American modern society should unionize to take on companies who have existed for almost a hundred years, who are embedded in government, and are VASTLY more funded and networked. Even if those music companies are losing money at this point.
However, I feel that I can present some very interesting alternatives that are working right now in the world today, in other facets of commerce, that are producing products that are superior to those that are supremely well marketed, namely when it comes to software and technology.
First, lets discuss technology briefly. I would like to introduce to you a theory called Moore's Law. In short, this theory states that CPU processor speeds on modern computers will double every two years. This theory was penned in 1965 and has held true every year since, and is not expected to deviate from this pattern until well into the NEXT century. That's 2100-ish people… We can make a simple assumption that other aspects of technology, including software development and internet technology, will advance at an equal rate.
I'm moved to ask this question: How does humanity expect to sell ANYTHING DIGITAL , SOFTWARE , or DATA BASED in the future?
Are we to sit back and ASSUME that all countries in the future, will follow United States of America copyright laws? Shying away from downloading anything digital via the internet, in lieu of respecting the bastion of capitalism, corporate integrity, and global ethics that is the United States of America?
nothing against USA, its capitalism, or its ethics but, forgive me if you can hear my laughter from where you are sitting.
Americans are still trying to separate God out of politics. That's an effort that roots back to the late 1700's! Yes, Americans have some deeply rooted issues. But I digress and realize I've gotten WAY ahead of myself....
The truth is, with all the copyright legislative effort taken in the United States today, anyone can find virtually ANY software consumer product via the internet for free, download it, crack it with a key generator , run it productively on their personal computer or laptop, and go happily on their merry way.
Anyone can find any movie they wish, often times BEFORE it is released in the theaters, download it or stream it online and watch from the comfort of their own homes. Without crying babies, or people having sex in the last row…
The same opportunities apply to TV shows of any country, sporting events, pictures, paintings, books, and music of course. ANYTHING a computer user could consider software can be found for free on the internet, in most cases safely, and with minimal effort.
Even being naughty in a digital world is simple.
With a small amount of internet technology knowledge, in the span of about five minutes, ANYONE can create an email server that belches MILLIONS of meaningless emails into inboxes across the world.
THIEVES! Miscreants! Communists! Technology is a crime! Technology is the devil! The internet and technological advancement are elements of the axis of evil and should be forsaken, feared, and burned in that ceremonial pyre along with Elvis records!
Okay, the following will be far from puritanical.

In taking a moment to examine these products, pay particular attention to the intention, product quality, and ethics of these groups, and in some cases, the PROFITS that they generate.

It is my belief that this style of commerce, development, and implementation is the future for all progressive artists in the United States. This will hold true for musicians, filmmakers, artisans, writers, photographers, and artists that we may yet not know how to classify.
