  A local disc jockey at a radio station in Amarillo Texas recieved a copy of our CD Boogalu' and liking a few of the tracks started playing us on the air. Keep in mind that all tracks are copyrighted and I am a member of BMI and songs are listed as so. Requests started coming in for the the songs and inquiries about the band so the DJ put them in touch with our website, www.michaelholt.info. The program director after hearing the requests called the DJ to the carpet wanting to know why he was playing music not on the "authorized play list" and just who was it he was playing? The DJ told him about us and that he was playing us on the air because in his words "their great!" The program director told him he was getting two weeks suspension for playin "unathorized" music great or not. the DJ said "fine, I'm just gonna play em again when I get back!" Details on the station numbers and the name of the disc jockey to follow tommorrow when I get the info. Any thoughts on the state of corporate radio in america?

Update: Disc Jockey Landon Shaver from KZRK ROCK 108 Amarillo will be reinstated tommorrow back on the air. I talked to Landon today and let him know that I will come and play a benefit to help him get his two weeks wages back. He told me over the phone that he could understand if it was music no one in the local area was interested in but that people were calling in to the station requesting the track "To The River" and wanting to know how to get a CD. I figure the most I can do is go and help a brother out. If you get a chance call in and request our song or fax a request. Here's their info.

Update March 31st:

Local NBC news afilliate reportedly stated that although newsworthy on a local level, they aren't willing to broadcast something negative against another news media across town! Too funny. If I was mad about all this it would be one thing, I just find the amount of bullshit at a corporate level very amusing.

Here is what is listed from the Govenor's music website from the radio station about themselves.

KZRK (107.9 FM) "Rock 108" is a 100,000-watt new rock radio station. We play the best of new rock by new artists, new rock by old artists and new rock by dead artists! Z-Rock is a station full of energy. We work very hard to promote our clients and ourselves in a positive light. Z-Rock contributes a great deal of air time on on-location events for many local non-profit organizations as well. KZRK-FM is fun!

Update April 15th: Landon Shaver DJ for KZRK 108 in Amarillo Tx was forced to resign as the station stonewalled putting him back on the air. Brandon told me everytime he called in to find out about what shift he would work he was told "we haven't heard back from corporate yet".  So finally Landon walked in with papers of resignation from his job at the station.

It is sad that this is the state of radio in the U.S. It used to be different. Renegade DJ's would risk airplay for acts they believed in and then if requests came in they could justify continued play of a song. Program directors were quick to give the listener more of what they wanted. An artist could start a regional buzz about the music in that fashion and then hope to break nationally. Now the program director is told by "corporate" who can and will not be played and they decide what the public will like instead of the public letting the station know what they want to hear. Keep in mind this is not across the board with every radio station, it seems to be a dominate theme in the big corporate owned stations. And even still that may not be the status quo. It just seems to be with this one.

Well Mike, the truth is the director was right. The station has to pay royalties for every song, but when a certain band is not on the list, than they could get sued.. All the royalties go to BMI,ASCAP, ETC. and they do monitor all stations . I wish it could be different, but it also protects you in a big way . I hope i did explain the other side .

I am a member of BMI and all songs are copyrighted with the library of congress so everytime my songs are played royalties are paid to BMI. There is no way a station can be sued for playing my music because it is all legal in the system like any other recording artist. I am currently recieving air play on three major stations in Canada, one in Australia, Europe, England and six major markets here in the states have picked up my music for rotation on their radio programs. So actually it really is a power struggle between the programmer who wants control and the DJ who wants to play music that people want to hear. I appreciate your comments but I am much farther along in the process as an artist than you may realize. If my songs were not copyrighted or if I wasn't a member of ASCAP BMI or SESAC you would be absolutely correct. Always good to hear from you.

By the way, "the list" is decided by the program director not by BMI ASCAP or SESAC. Decisions on who should be on the list have been forever decided by a form of "payola" recieved from independent promoters who go through a region pushing artists for major labels in the industry who pay the independent promoters to pay the radio stations. Major labels used to have personnel who handled this directly with radio stations until it was outlawed by the FCC. At that point independed contracters where created to pass the money along in many fashions to get radio play for their artists. This is how hit singles have been "manufactured" for years. From time to time a song makes its way through the system on it's own merit but that is not usually the case. However, the tracks being pushed that have the most staying power tend to be better and stronger songs sometimes than those that don't stay on radio no matter how much "payola" is involved. Many books have been written on the subject so this in not "opinion" but based on fact. If you would like I can direct you to the reading material quoted.

Good ole Bureaucratic mentality strikes again!! sooner or later these idiots have to realize that WE (the real musicians) are not britney spears backed by a very powerful lawyer who will sue at the drop of a hat!! We don't care about that shit. If that's what the powers that be even think about...

Lemme know when you wanna go up there, or what the plan is, so I can plan as well...

You just don't have the corporate sponsorship and green light from the powers that be... Just when you think things are actually changing, even in music shit like this happens..... WOW. Well, this is an interesting situation, and it can only be good for Michael Holt & The Trophy 500's. I bet you'll see some CD sales from this. I'm afraid it could go badly for the DJ, though, unless the controversy gets so big that it draws more listeners to the station. Every commercial radio station has a program director whose job is to maintain a format, and they don't like renegade DJ's who stray from the format. Free Form Radio is the realm of independent DJ's on public, pirate, and internet broadcasting. Landon Shaver is likely to be looking for a job if he pushes the issue. There is no legal issue here - Nuno's apologist attitude is uninformed. As long as the DJ records playing the song onto his log, everybody's cool. Licensing agencies (BMI, ASCAP, SESAC) work for their members, songwriters and publishers, not the labels. It is the legal responsibility of the copyright holder to collect royalties due, and that's why we join these organizations. They are the enforcing agents of our rights. Unfortunately, the formula used for dividing up the millions of dollars the agencies collect has been heavily influenced by the major labels, who lobby BMI, ASCAP, and SESAC relentlessly. For the independent artists like us, the value of simply being exposed to a new audience far outweighs the meager royalties we will probably never see. Even the major labels who are paying for airplay are using the airwaves to sell product, not to collect royalties. For them, the royalties are just a happy side effect that benefits them if they happen to own the publishing rights to the songs they are promoting, which I suppose they can roll back in to their payola budgets. Anyway, with that said, Way to Go Michael. DIY comes through for you! You're gonna be HUGE in the panhandle! And good luck to Landon Shaver.

I read your bio today on your website...you've had an interesting life which is conducive for writing some pretty nice blues songs. Thanks for being upfront and honest. That is refreshing in this day and time.


About your blog...about fifteen years ago I visited a friend at work who is a DJ at KGSR in Austin. I was shocked to discover that they used authorized play lists. Because I don't listen to radio very often I had no idea that most radio stations did that. I was so disappointed. I started requesting that they play Alan Haynes on their blues show and from time to time they would.


Use this to your advantage...and contact the Austin Chronicle!
