This is actually a blog i wrote for www.mikesouth.com but i decided to post it here as well:

Sacramento, CA- A tax levy on the adult industry to the tune of 25% of all gross receipts was brought in front of the fiscal committee by a turkey-jowled Charles Calderon yesterday. His concerns were that the adult industry, contributing 4 billion annually to the CA economy, was not pulling its weight. His real concerns were that the CA budget deficit is extraordinary, state employed union members might be laid off, and some vague floating morality that he has never quite been able to grasp with any conviction may or may not have been violated.

Here is why the adult industry is not pulling its weight:

"The in-state production of adult entertainment and adult entertainment merchandise has numerous negative secondary effects on the people of this state. Specifically, the production:

i) increases crime at or near production locations

ii) adversely impacts the mental health of, and leads to increased alcohol and substance abuse by, those involved in the production;

iii) increases the performers' chance of contracting a sexually transmitted disease;

iv) encourages unsafe sex by consumers; and

v) often encourages sexually aggressive behavior towards women. "

-from the summary of the bill AB2914 authored by Charles Calderon.

He goes on to claim that as performers, we leave the industry "uneducated, unskilled, unemployed, addicted to drugs and on welfare".

The Rebuttal (this one should automatically get bonus points because its backed by empirical evidence):

i) No published or peer-reviewed studies have shown that adult entertainment venues have higher than average police calls or crime rates in surrounding vicinities. I don't even know what else would need to be added to this argument. It's just not true.

ii) No studies have even been done on the increased use of drugs and alcohol in the adult industry. Furthermore, having worked in both strip clubs and on adult video sets, I can tell you that drugs are not tolerated. No director is going to hand meth to a girl and expect a good scene, as Shelly Lubben claims (we'll get to her). The adult industry is a business and drugs slow business production.

iii) Our rates of sexually transmitted disease are lower than the general population. We are tested every 30 days. AIM finds an infection rate of 1.8 percent every month for gonorrhea and chlamydia. There have been exactly 17 cases of HIV in over ten years (and Calderon, who did his research by watching HBO, says that 5,000 new girls enter the industry every year. Do the math). When we enter the industry we are also tested for syphilis and given paps. There are vaccines for HPV and certain types of hepatitis. I have been tested regularly for a year and a half now. I have never had a dirty test and I've had all of the vaccines. I would be more than willing to post my test history. As far as herpes go, our rate of infection is exactly equal to that of the general population. But really that is not the point. The cost of our STDS to the state is exactly zero. We pay AIM to take care of this. We don't wait three weeks to be approved by the state for free STD treatment. That would be three weeks out of work when we could buy some chlamydia antibiotics for twenty dollars from AIM.

iii) No studies have been done concerning whether porn increases promiscuity or not, and even if it did, so what. It is not the state's job to regulate our sex habits or tax us for not abstaining from the evil temptations of lust. And please Mr. Calderon, define "unsafe". Do you mean out of wedlock?

iv) Porn does not cause rapists. Sex crimes have only been declining and porn has been going more mainstream. Half of all internet searches are sex-related. That would be an awful lot of violence against womenfolk don'tcha think? And again, there are no peer reviewed and published studies to support this notion. But for argument's sake, let's say there are people out there who only feel it is right to beat on women after they see a pretty girl screw on film. To be consistent, we should find a scapegoat to tax every time someone is shot. But are we taxing the company that made the gun or are we taxing Grand Theft Auto… I can't make up my mind.

Porn addiction was also brought up as a ghastly secondary effect of this industry. Porn addiction does not exist. Sex addiction does exist and existed before the industry and will continue to exist even if the industry is run out of CA. But again, if we start taxing the objects of addiction then it needs to be consistent. I got up in the middle of this blog to go on a Starbucks run. Who is drafting legislation against that?

Onto education, skills, employment, welfare…. and the oft repeated drug addiction.

If we were to show the education trends of workers in this industry on a scatter plot, it would look like a polka dot dress. Yes, there are girls who did not graduate high school. There are girls with PHDs. There are girls who come in with degrees and girls who continue with school while they are in the industry and there are girls who make a lot of money now and then leave the industry for school. There are girls who will misspell their own names until the day they die and others who will become business tycoons and probably employ the very assholes who assigned them some kind of value judgment based on their line of work. Why does it seem like something is missing though…. oh yeah, because the girls in front of the camera are not the only people in this industry. Admittedly, I'm only making an assumption, but the directors and photographers and editors and writers and graphic artists and make up artists and boom guys and lighting guys and web designers and business owners and vague entrepreneurs all have either an education or skills. Anyone with a sustaining career in this industry by definition would have something worthwhile to contribute to it. Suitcase pimps don't count though.

If we leave the industry unemployed that may be due to the fact that we are now, uh… retired? Brilliant! One builds an entire career in an industry, puts away money, gets old, and stops working. Novel. Once again, Calderon is focusing only on the 2 girls in front of the camera and ignoring the 25 people on set behind the camera. They do not stay in for five years and then become a burden to the state as Calderon so eloquently stated. But, since the focus is on those fuck up girls, i will turn back to them. Reasons some girls leave unemployed: They went back to school. They got married and are now housewives. They really did put away enough money that they won't have to work again. Or, and this is entirely possible, they left unemployed and will remain unemployed during their job search. I personally have been unemployed before this industry. I'd had it with the job I was at and I quit. And I was unemployed for ten days while I interviewed for a new job. It was a huge burden on the state but I guess thats why I pay taxes.

On welfare. Please. What newly retired porn star with her brand new Mercedes, tax statements showing a six figure income, and still-perfect body due to the fact that she's never had a kid is going to pull up to the local welfare office and qualify. Spare me.

Drug addiction. I'm getting back to it. More reasons why industry workers can't be drug addicted:

i) Most industry workers are not actually performers and they have deadlines and obligations and probably families and normal lives. This is not conducive to drug addiction.

ii) Drug addicts are ugly. Porn favors pretty. If two girls fit the mold for a look you are trying to work into a scene will you go for the one with rotting teeth, scabs, and vacant eyes or will you go for the one who just looks like a normal girl? Or, lets say the drug addict looks normal. In that case will you go for the girl who is reliable and can remember her lines or the one who may or may not show up and can't even read her lines because they are threatening to stab her and floating off the page whenever she looks at it? Drug addicts will be weeded out. There are too many girls willing to take their place.

iii) This industry already has so many people breathing down our necks. Are we really going to shoot a girl up with heroin on set or at a strip club (as Daphne Khoury claims- yes i'll get to her as well) knowing that the religious right is looking for any reason to shut us down and also knowing how replaceable she is with someone who is absolutely fine with being naked and sober simultaneously?

iv) Porn does not cause drug addiction anyway. Correlation is not causation. Many girls who propel the myth are girls who were already addicted before the industry and then turned to it to try to make a quick buck to feed their addictions. They don't last long. As I'm defending this industry please note that i'm defending the mainstream part of it. No one can control for the fringe dwellers and we don't legitimize them.

iv) Let's get to the real reason why this is such a bothersome statement though. The underlying assumption is that recreational sex and sex as a commodity is so evil and dirty and wrong that the psyche cannot handle it without resorting to substance abuse. This is coming from the very group of people who should be counseled on sex because they have managed to distort it into something larger than life. They see it everywhere and feel victimized by it. They worry so much about it that they have stripped their lives of it entirely, but that is not enough, because other people obviously don't see the danger in sex and so they must strip other people's lives of it as well. For their own good of course.

50 million Americans were patrons of the adult industry last year. People who like and enjoy sex and have positive views of it are not unhealthy or unstable. People who fear it and would take away your rights to it are. This bill is not about about making the adult industry "carry its own weight". This bill is a poorly veiled attempt at censorship. If you don't believe me, then lets go back ten years in time to another bill that had the exact same goal but failed. The first time this bill was introduced it was introduced for moral reasons rather than budgeting reasons. Calderon is relentless. If passed, the adult industry would effectively be forced out of CA. The 25 percent tax would be taxed at every level. This means it could be applied as many as 5 times to the same product. We cannot take 125% hit. When Calderon was asked about this, his response was, and I quote "The adult industry cannot leave California. This is the only state in the US where shooting porn is not called outright prostitution or pandering. They will be forced to pay it." He's wrong. The video industry can and will leave CA if this bill is passed. We already do shoot outside of CA but if we had to it's not as if a scene has never been shot in Budapest if the remaining US is off limits. From what I hear the girls are damn hot over there. Not only would the adult industry being forced out be a grave moment in the history of a nation based on democracy and freedom, but it would be a huge economic hit to CA. 4 billion is made every year in CA from this industry and it provides 40,000 jobs. Calderon would be willing to take all of this from Californians if it meant he could get his agenda through. In a memorable quote that I'd like so sum up this paragraph with, Calderon said, when addressing his committee, "We are the California Government. We can pass whatever law we want."

To really drive his point home about what fuck ups the girls are, Calderon brought in two extreme fuck ups to testify. Shelly Lubben and Daphne Khoury, ex-pornstar and ex-stripper, respectively, showed up in church-appropriate attire and fake eyelashes as shining examples. Shelly Lubben was in the adult industry for a total of 7 years, two of which she spent making adult films, most of which she hooked, and all of which she spent addicted to meth. While hooking and drugs are not prerequisites for this industry they obviously were in her case, as they came before the videos. Yet she claims she is/was screwed up because of the industry and didn't know how to get out. Like any other job I can tell you that simply quitting should do the trick. But Shelly isn't content with quitting. She won't be happy until everyone does. She testified to Calderon's committee that she was fucked with scissors on set, given drugs, caught genital herpes, and "couldn't understand why it was legal for guys to get bodily fluids on her skin" (not kidding). She thinks that girls in this industry are lost and it is her job to find them. She claims that we have higher than normal suicide rates and that since she started her Pink Cross foundation (as I understand it there are only about 5 members) she has managed to "save" about ten girls a year and deal with one suicide attempt a year. These statistics of course should be applied to the 5,000 new girls entering every year that were previously mentioned.

Daphne Khoury, who appeared to be the more put together of the two, was quick to change my opinion of her once she opened up the water works in her testimony (Shelly did the quivering voice thing). Not that either of them would care to hold the development of law to reason rather than emotion though. Daphne claimed that she thought stripping was harmless at first, then she got addicted to heroin that was provided by the club owners. At the press conference earlier in the day I had wondered why she kept complaining about STDs as a stripper. Then i realized the problem. She should have been complaining about STDs as a hooker. You don't catch herpes from lap dances. You catch herpes from riding a john's dick. So as the story goes she was hooking and addicted to heroin and after numerous suicide attempts finally got help and quit the strip club. Arguably I think anyone with a herion habit and severe depression and a side job as a prostitute would probably quit their day job. I've known a lot of strippers in my lifetime. This is not a normal story. She ended her testimony with the admission that she is still getting help and battling depression and now she's scared because her life was threatened if she spoke out and she supports AB 2914.

I know I brought this up earlier but correlation is not causation. I would suggest that Shelly and Daphne would have been fuck ups without the industry. Obviously there is no way to prove this. I don't really care though whether Shelly and Daphne have problems because of the industry or independent of it though. It's irrelevent because either way they represent an extreme minority. What is relevant is the underlying ideology behind these two "reformed women".

Both Daphne and Shelly went into this industry on their own accord. No one held a gun to their heads. (But did i mention that Daphne claimed to have been forced into prostitution- was this by her drug habit?). While in the industry they had all the same options available that the rest of us industry workers/"victims" still have today. They had the option of not doing drugs. They had the option of not being prostitutes. They had the option of leaving at any time or making something of themselves in the industry. They could have gone to school or invested the money or developed a skill that would have been useful for their entire lives. They could have bought a house or somehow planned for their futures in some way. This industry can be the greatest springboard for our futures if we only take advantage of it. But they chose not to take those options. Instead they chose to be weak and follow the path of least resistance. Now, eight years later, rather than regrouping and coming to terms with their mistakes and moving on, they are attacking the industry. They are using extreme cases and making them appear to be the norm. They are citing opinion as fact, and in most cases I believe they are outright lying but how does one prove a negative? The ideological and moral flaw is even deeper than this though. They are actively trying to take away my right to succeed in this industry, and the rights of every other person involved in it, and the rights of every past, present and potential consumer. These girls, who couldn't even manage a career in one of the easiest industries on the planet, think they are smarter than you or me and know better than us what is good for us and what legal rights we should have as a result. They are so steadfastly convinced of this that they will lie to a committee, take time out of their lives, support a bill that doesn't even directly state what it is trying to accomplish (because if it were written honestly it would not have even been heard), and emotionally attempt to manipulate the legal system to get their way. That will always be more morally disgusting than a happy and willing pornstar spreading her legs for the camera or a self sufficient stripper transferring her tips from her g-string to her college fund.

Regardless of an extremely dishonest attempt at using government as a tool against the adult industry though, it looks as if Calderon might have failed. Among 150 people who showed to stop this bill in its tracks were Larry Kaplan from ACE of California, "Mr. Kinsey" as Calderon childishly called him, a group of over 100 dancers, club owners and managers, bouncers, porn stars and general supporters, myself, and my personal hero now, lobbyist Matt Gray. Mr. Gray's closing argument was so cutting that Calderon could do nothing but stand by and huff and roll his eyes like a teenage girl being given a curfew on prom night. Calderon chose not to vote on the issue that day.

Surely the porn industry must be taxed in exactly the same way as the mainstream movie industry?

You both make films and you both have by-products of those films. Although the it may be difficult for some people to see the connection between a plastic model of Jabba The Hut and a 'Julie Ashton Pussy and Ass' the connection is there.

Mind you, I'm English and the American tax and political system seem ridiculous anyway.

You get BIG bonus points for the 'correlation does not equal causation' comment. I know a lot of intelligent people, but that one even escapes most people. For the people that don't get it, I usually look at them and ask "Do umbrellas cause rainfall?". Suddenly the lightbulb goes on!

Empirical evidence! Again, bonus points for you. It was very well articulated, logically laid out, and impossible to dismiss. Unfortunately, as you and I both know, most people go with their 'feelings' and evidence be damned. The gun control crowd is exceptionally guilty of such 'reasoning' and 'common sense'. Apparently the Marxists that seem to be running your State seem to be more governed by their 'common sense' than by...errrr......FACTS! Pesky things that they are.

After all, its 'for the children' don't you know!

Anyway, its late and I could comment further, but don't feel the need. You hit this one out of the park. Why am I not surprised? :)

I bet you would make mincemeat of of Tyra Banks! I'd like to be in the audience to see THAT! I highly doubt she could even grasp half of what you would have to say to her.

You should get Charles one of those Che t-shirts. I think it probably fits. Or maybe a subscription to "Reason".

I Have seen your recent post and have to say your post is truly outstanding, specially this one.
I would have to agree with everyone that yes you are very smart, beautiful and outstanding.
The only thing that I have to say about it is that by me being in the industry for almost 10 years (Dancing for 3 and doing films for almost 7) There are many drugs in the industry, inclusive I can say that even the contract girls that seem like they would not do any drugs because they have no marks and look perfectly normal do drugs.
We both where/are fortunate to have had such a great company backing us up like Adam & Eve (Witch they stand behind their no drug policy). Reason why Adam & Eve do not have so many contract girls and you can verify if you like is because the entire time that I was with them, they wanted to have more girls join the team and every single time they would find on that they loved, and then they would end up finding out that they did some type of drug, most of the time the drug of choice has been crystal meth (Witch is said to be harder to brake and get out of then heroin). From my experience in the in the industry ALLOT of people would say that I was maybe a little standoffish because I never wanted to hang out with the girls in the industry, I would show up to the parties do my job and leave, and I liked most of the girls and people there, but the truth of that was because most of them did drugs and I never wanted to be affiliated with that, so I stayed away, stayed away for my entire 7 years in it, the first year or two I was pretty naive and stayed around it and saw how things where, I only had two friends witch where Terri summers and Kitty. Is it sad; yes very sad but it is the truth.
Besides that, I do agree with what you say, you do not have a gun put to your head and you are in because you want to and if you want to leave you could at any time.
Problem with many of the girls that are in it and want to get out is that unfortunately they don’t have a education or others means to survive and the industry providing you so much income that choice sometimes its very difficult to make and most of then dont want to go back to the $7.00 H Salary when they make $700-$1,000 a day.
But you are smart, know your shit, don’t do drugs and have a education so you would not fall in to that category, witch of course is something you should be very proud of :)
Anyways baby, Great post, the industry does need more people like you that have the hole package, as soon as I saw you I did recall telling Bob that he won the lotto with you, and that is about time they found a girl so pretty that did not do drugs and that was smart,that of course had the entire package they have been looking for .

I don't recall the case off the top of my head but the courts have ruled against these taxes before. It is a CLEAR case of censorship by tax. The Supreme Court has ruled that if you were to tax speech based on content then you are limiting the ability of the people to present their protected speech to the public.

If the state were to decide to tax political rallies by third party candidates but not by the Republicans or Democrats then you would limit the people that may go to hear what the other parties had to say. If you were to tax the NY Post but not the NY Times you would be limiting the ability of the NY Post to report the news they wish to report. If you try to tax adult based speech solely because it's adult content then there is no fundamental difference is there? What is the difference between Kayden's Krossfire, No Country for Old Men, or Teenage Bikini Cavegirl? Aren't they all the same once you remove taste from the equation?

I am currently battling the state of NY over the same issue. The state wants to collect sales tax from the cover charge for my gentleman's club. The state does not collect tax on admissions to theater, dance, theater in the round, movies, concerts, etc. We have challenged this as a violation of the First Amendment. The state has previously upheld that gentleman's clubs are protected forms of artistic expression. They went as far as to say there was no discernable difference between gentleman's clubs and ballet other then the people that may be interested in attending.

I have a hard time imagining that CA will be able to get this law passed and if so it will be overturned. ACE has been battling cases like this far too often lately. Utah and Texas are two states that I know have attempted to institute taxes on adult businesses in recent years. I believe the Texas tax was found unconstitutional and I know Utah's is still being challenged. Remember the next time you step into a booth to cast your vote that these are the people who will be passing these laws to limit your ability to decide for yourself what you want from your life.

Very well written and you supported your opinions very well. The porn industry is a cross section of the American life. Are there drugs addicts in the porn industry - yes. Are there drugs addicts in the legal profession, the mainstream entertainment industry, the auto industry, etc. - yes, yes, yes and yes. There are drug addicts in all walks of life.

Does porn cause drug addiction - no. Does the legal profession, the mainstream entertainment industry, working in a factory, etc cause drug addiction - no, no, no and no.

I have been viewing and enjoying porn for over 20 years (yes I'm an old dude), but I believe that most people would consider me to be normal (whatever that is) and a law abiding citizen. I do not and have never done any drugs so obviously my "porn addiction" has not led me down the path of destruction and into a drug crazed world. I have attended the AVN convention for about 10 years now and I can say that the majority of the people that I have met in the industry are some of the best people I have known. I am not only referring to the performers but also the people that I know that work behind the scenes.

The "tax proposal" seems to be very unfair. The porn industry should not be taxed any differantly then any other industry. We citizens need to take a stand and start to vote politicians like Charles Calderon out of office.

I like your style of writing. It is bold, you get right to the point, and you set the tone up nicely. You should see if you can get this published in a magazine that will help fight bullshit legislature like this bill Mr. Calderon is pressing for. A 25 percent tax on the industry is ludicrous.

I have known strippers in the past and none were drug addicts or prostitutes. They worked as strippers at night while they went to college during the day. I am a junior in college now and it is damn expensive. Financial aid such a student loans and grants help pay most of it but I still have to work to pay for the rest of my college education and to pay for other expenses such as housing and utilities, transportation, food and school supplies.

Kayden you keep writing and posting blogs on this subject and the word will get out about politicians such as Mr. Calderon and stupid ass legislature such as the one he is proposing. Good job Kayden.

I DO think there is empirical evidence that jacked up politicians cause a loss of freedom however ;)

Great Blog Kayden, I always knew you are different, you are educated and really smart, I love the way to write and expose your thoughts, My girlfriend Rebeca Linares (you can see her in my top 1) is very close to me, we meet each other since a long time, he was working in Spain in Porn and now she is working in porn valley since two years ago, she is a Splieger girl, we talk everyday by phone from L.A. to Madrid and she tells me a lot of things about the adult industry, she says the same that Carmen Luvana unfortunately there a lot of girls in drugs ever being contract girls anyway I am totally agree int the rest of your reasoning anyway I am sure if all the girls in porn were like you (I mean inteligent and educated) she never could being in drugs.

Excellent blog, Kayden!! You are one brainy beauty!! Thanks for bringing this to everyones attention. Being in the midwest, I had no idea they were even trying to pull something like this. Yet another example of collectivism rearing its ugly head. If they dont outlaw something, they try to tax the hell out of it-- for our own good (yeah right). It always starts off with easy targets like porn or cigarettes, etc. When are we going to wake up as a nation? We are losing our rights and freedom little by little. It's death by a million paper cuts. They recently passed a bunch of anti-smoking laws around here. Again, it's an easy target since a majority of people dont smoke. We have become a society that says "If it doesnt affect me, I dont care". Take a look at what happened to those polygamists in Texas. I am not sticking up for polygamy or anything that those people may or may not have been doing, but they definately had their rights violated. People dont care because of what the accusations were and they were polygamists. One anonymous phone call comes in (which turned out to be a hoax) and they raided the entire compound and took over 400 children away from their families! Is this the nation we are becoming? I would have no problem if they went in and investigated them thoroughly. Any children being abused should be taken out and the abusers should be punished to the full extent of the law, but you cant tell me that all 400 children there were being abused. Anyway, good job standing up to these idiots. Every battle we can win for freedom is important at this point.

People in authority like easy targets, because they don't look like bullies when they attack. Politicians love sin taxes, because the objector(s) are alienated if they speak out. In WI we're getting a tax on video games. Some place down south there was proposed a law against overweight people eating in public. I lived in CA in the early 70's & I don't think I would want to come back, because of all the problems.
As for drugs. Every industry has some personnel with some kind of addiction. So-called mainstream entertainment as many public cases. The adult industry sadly has too many drug causuallties. When you have people willing to hang out with people like Bobby Black, its hard to keep plugging the hole in the dike with your finger.
I've met various strippers, some who posed for major adult mags. And some of them used drugs. There was a character, named Mike, who was treated like a king. He was used money & coke to ply the girls.
I asked a bartender about this & she replied that when girls start getting money, they seem to want to try everything.
But getting I agree with you that this tax is wrong.

She once claim male porn star Christian www.christiansingstheblues.com was hero of hers becuase she beleave that all bad thing he say about porn on his web site think help her cause. Yet what got egg on Shelly Lubben face was fact Christian did leave porn after said bunch nasty thing said about being porn star. He than recant ever thing said was nasty about being male porn star. Than told ever one that no better job than being male porn star. Make Shelly Lubben look like dumby. If look how many porn stars Shelly Lubben say she has turn from porn you could count number on fingers toes. That might small number compare to those still in porn. PORN IS NOT GLAMOROUS. GET THE FACTS. GET HELP.

Oh god. Where to start….

Lets get the stupid one out of the way first. I can’t speak for others but I did not get into this industry for the glamour. It would take a serious lack of brain function to associate getting splooge on the face with glamour. Getting splooge on the face is fun, it’s profitible… it’s often a good blooper…. it is not glamourous.

Same goes for splooge on the butt, titties, stomach and splooge sucked from someone else’s mouth (special nod to cumswapping). On the flip side, splooge on the face is not the cause of mental woes and drug addiction either. Its just really not the big deal Ms. Lubben is making it into. And don’t tell me girls think the awards shows are glamourous. All they talk about at the awards shows are splooge on the face while they distribute trophies for the girls who took the most splooge to the face. There. I’ve exhausted it.

Ok now here is my real problem with this flyer: It is not a fact sheet. It’s propoganda. Fact sheets are unbiased. Propoganda is worded to sound as good or as bad as it possibly can. Facts appeal to reason. Propoganda appeals to emotion. What if all of these numbers were converted to a percentage? I had a hard time when I was trying to figure out what numbers to use when converting this over. I don’t honestly know how many performers enter the industry every year and I don’t know where to find that information. I don’t know how many performers are in the industry right now. I couldn’t even ballpark it. Conveniently though, Charles Calderon knows. He says 5,000 new performers enter the industry every year. And I’m going to use that figure for this case, because it is a felony to lie to the committee and he said it to them. So it must be true (;

Ok, so nine performers died from HIV, suicide, and drug overdoses in 2007. Nine divided by 5000= .0018. Move the decimal over two spaces we’ve got 0.18%. Less than one fifth of one percent of the performers in our industry died from drugs, aids, and suicide combined in 2007.

Next point: “66% of porn performers have Herpes, 12-28% have other STDs”– I know as I’m typing this that it’s not making our industry look very good, but we don’t test for Herpes. It’s not required so we don’t get it done monthly at the local AIM clinic.

Where is she getting this number? I’m not saying there isn’t a porn database out there tracking our every herpetic move, but by god I’ve never heard of it and I doubt if a performer found out he or she was positive for herpes through a private doctor that information would be available to the public. Where is this information listed? I want to know who not to work with.

Anyhoo, Lubben testified to the committee that 90% of us had STDs. This fact sheet states otherwise. If 66% of us have herpes, then 34% of us do not. If she were stupid (she is), she could get her calculation by subtracting the 12-28% of “other STDs” from the healthy and vibrant 34%, giving her a guestimate that 90% of us have STDs (what are “other STDs” anyway, if she’s counting bladder infections she’s really reaching). But, there is bound to be overlap.

Some of the herpes victims will be among the unfortunate 12-28% of vague ”other STD” victims. So 90% of us do not have STDs. I knew it all along. But wait! jump down to the last bullet point: Between 2003 to 2005 (does that just sound grammatically off? I’m copying it as it’s written), 976 performers were reported with 1,153 positive STD test results. Okay… 2003, 2004, 2005. 3 years multiplied by Calderon’s 5,000… 15,000 people (yes I know….

I don’t honestly believe that we can go with the nice even number of 15,000. I just needed a figure for the argument). 976 divided by 15,000= 0.065. So 6.5% of us tested postive for STDs between 2003 and 2005, some of us had more than one. What the Fuck? That is a direct contradiction to bullet point number two, and bullet number two was proof that her 90% testimony was a lie. Oh the webs we weave.

Bullet point number three: “26 porn performers have committed suicide since 1990″. Assuming that this is true, that would mean that in 18 years we’ve lost 26 performers to suicide. We have 1.4 suicides per year on average. 1.4 divided by 5,000= .00028. 0.028% is the industry suicide rate. Or, to make it very clear (5,000 x 18 years= 90,000), 26 out of 90,000 people have committed suicide. I hate to be callous, but it doesn’t seem so high when given a reference point.

“45 performers have died from drug overdoses since 1990″- You’ve seen the math above I won’t go through it again. 45 people out of 90,000.

“Out of about 90 HIV positive porn performers, about 25 are living”- First, I’m very uneasy with “about 25 are living”. There should be a concrete number here. How do you ballpark how many people are alive with a number this low? All that tells me is that someone didn’t do all the research. It is not hard to verify whether 25 people are alive or not. It doesn’t matter though. I’m just surprised that it seems somehow relevant to mention that some people have died from a fatal disease. Numbers game! About 90 minus about 25 equals about 65. I’m assuming these numbers are from 1990 onwards (everything else is), so about 0.07% of porn performers are living with HIV and about 0.02% have died from it. Looks like we’ve got our aids under control!

A few last words before I sum it up. The first point talked about STDs, suicide, and drugs. Then the next point talked about STDs. Then the next point talked about suicide. Then the next point talked about drugs. Then the next point talked about STDs. Then the next point talked about STDs. I realize that by filling the paper it looks like there are copious amounts of problems in our industry, but that first bullet point pretty much did it. She’s wasting trees.

Goddammit Shelley! I could respect a foundation that was just there for the victims who truly needed it, but quit trying to scare us into thinking we’re victims. I like getting splooge on me and I hope I someday win a splooge-related award (Goddammit Bree Olson! Stop winning everything! Congratulations by the way), and I’m at peace with the odds I’ve calculated here. I think I’ll make it out of this industry alive.

Got to love sin taxes. Whether it's porn, alcohol or tobacco, when politicians want to get more revenue, they love going to the vices. It's not about getting anybody to stop doing anything, it's about raking in more revenue from something most Americans won't have a problem with. Like with the SCHIP thing, it would've been paid for through an increased tobacco tax. Would've been easier, and much more sensible, to close off some loopholes that allow the uber rich to avoid paying taxes. But no, those people contribute too much money to campaigns, and own the media, so tax a vice instead. Couldn't be bothered with putting a sales tax back on yachts, the privileged shouldn't have to pay taxes, at least according to the politicians. Not that they'd ever actually admit to such an attitude, but it's there. How many middle income Americans can set up tax shelters and take advantage of all those wonderful loopholes that allow billionaires to avoid paying taxes? Not a one.

Sorry to veer off course, I'm right there with you on this one, even though you are a fan of Ayn Rand.

Good lord, Kayden! I can testify to the fact that you are extremely beautiful, and I have recently written that you are an intelligent lady. Man, was that ever an understatement!

This blog was is one of the most excellently written articles I've ever read! I couldn't have written this piece on the best day of my life, and I claim to be a columnist!

One last thing, I can say that, to the best of my knowledge, the owners and management of the clubs I frequent would promptly and uncerimoniously evict any dancer or employee there caught doing drugs, selling drugs, or drinking in the club. I won't go into detail, but a couple of years ago, one of said clubs fired a feature dancer because she was caught doing drugs in the dressing room.

I too have been a recent target of either Shelley or her disciples.... asking me what prison I am in and that I am in despair. I blogged about it extensively and have been the target of so called 'christian loving people' who say things like I am a slut because I choose to shoot adult scenes, get naked on camera and enjoy it. I will say this til the day I die, take any industry be it trucking, lawyering, doctoring, or otherwise - each industry has its own share of drug addicts, booze addicts, and problems. If you do not keep your head on straight and do things that you know inside are not right, like doing scenes you do not want to do, having sex when you really do not want to, or doing drugs so that you can numb yourselve to sleep, then sure, it is going to end up in a very, very bad place - and a place that is publicized by people with an 'I told you so' attitude. Actors in adult will always be a focal point - that is why there are sick things like websites listing the names of adult actors who have died and how they died. Let me see the stats on lawyers - if they exist. They are likely worse.

Fantastic piece. The attack by crusaders of 'moral' is ludicrous. Actually, the opposite is true. The culture of repression and Puritan-posturing creates monsters, rapists and pedophile priests. When Sen. David Vitter wasn't busy introducing women-hostile/ anti-choice legislation, he was wearing a diaper at the late DC Madam's establishment.

The old argument that serial killer Ted Bundy became crazy by pornography has not held up to science any more than the above assertions. They may as well have said that Bundy drank chocolate milk so there needs to be a crusade against dairy. Bundy was a violent socio-path. No film or book is going to manufacture that. He was more a product of the weird culture of hypocrisy, than on erotic entertainment.

The tax proposal is an outrage. California legislators screwed up. They had spent far too much time in bed with Enron and so many other similar corporate criminals. The adult industry is not appropriate to target as a means to recover from the state's mistakes and corruption. Such posturing too closely resembles the Taliban .. pandering to religious extremists and people who try to keep their own sexual behaviors secret.

Wonderful blog. You are one smart woman and I'm glad there are women like you in adult entertainment. You prove that you can still be an adult entertainer and not have to check your brain in at the door. I believe you and many other adult entertainers are living proof why Shelly Lubben and others are wrong about adult entertainers. Most models and entertainers are just like you in that their going to college and/or doing other things to better themselves on the side. Thirty years ago, (when Shelly started in the porn industry) women went into porn and made a career out of it, possibly getting involved in destructive relationships and drugs on the side. But I believe women are smarter than that now. Women like you seem to join the adult entertainment business because you like it and it helps pay for college. OF course there's still a few women out there that are doing all the wrong things and making messes of their lives, and there are women that do make a life long career out of the adult industry but remain perfectly fine, but judging by the decreased teen pregnancy and abortion rates, I think women are much smarter now, and have better control of their lives than their mothers did. In fact women seem to have their heads on straighter than most men these days. There are a lot more women graduating college then men. Me and most my guy friends barely made it through high school and either we went for a semester or two, which is what I did, or didn't go at all. (To busy with women, porn, sports, partying, and alchahol. Hey there's something they should go after, "Men getting addicted to porn making them dumber." lol ) Most of my gal pals partied too, but they were also going to school and most of them eventually graduated and have very nice careers now including my ex and my sister. Meanwhile I'm just holding on to what ever work I can get. Anyway I'm off on a tangent, so I'm just going to stop and say again: great article.

This piece is just one of so many reasons why I worship intelligent porn starlets: They aren't afraid to take names and kick ass when needed.  And Shelley Lubben is one who deserves a serious ass kicking indeed (figuratively speaking, of course).

As noted by Vicky Vette in the comment below, you aren't the first nor will you be the last to be assaulted by her "ministry" of self-hate and loathing...and the fact that some in the industry are even going so far as to enable them to propagate their smears and lies and distortions about porn performers in general. No one would deny that the industry has its issues and problems...but to simply reduce everyone to the worst common denominator and extrapolate your experiences as if they were universal of all porn stars (and doing 5 films and ONE photo gallery probably does  not make you a "star" by any standard, either)...that is stretching it to the least.

And how stupid this Calderon fellow must be....they can't settle on ways to save California from financial meltdown, but they sure can go after the "sin taxes" and attempt to drive a legitimate revenue generating business out of their state. Stroke of genius, Caldeon...you Mensa Jackass. And too chicken to vote on his own damn proposal, too...nice representation, dewd.
