Hey musicians, here's something you might chime in on. If you don't know what I'm talking about, ignore this post.
So I'm getting a modest amount of national airplay. (Especially the mixdown of "Chocolate Rain" that I've had up).
If I registered "Chocolate Rain" with BMI or ASCAP, I'd collect royalties on these performances. [E.G. when Opie and Anthony decide to play it for CBS and when Carson Daly decides to play it on NBC].
But I hate hate hate what BMI/ASCAP do to mom-and-pop cafes, nonprofit radio, and small businesses. They charge licensing fees to people who can't afford them and/or don't make significant money.
I'm pretty sure CBS and NBC can afford to pay royalties when they broadcast my stuff to millions of people. But I dislike having to go through BMI/ASCAP because they totally screw the little guys.
If I could afford $250/hour for an entertainment lawyer, it might be possible to pursue performance rights against large corporations like CBS without BMI/ASCAP. But since I can't, I'm left in a bind.
I want nonprofit radio and small mom/pop cafes to be able to play my music for free. But I also want giant corporations who can afford to give me a dime or two to pay fair royalties. I want a fair piece of commercial uses of my music. There is no solution that allows both.
What should I do?
