I know this is not a Sunday topic but it is a relevant topic. And more than a few of you are involved in such situation. I have a little first hand knowledge on this subject and I will try to clear up a few inquiries.

Intimidation
In any form is harassment. If a person you suspect is harassing you but is trying to conceal it because the situation you are in requires you to have contact you need to include correspondance by email as your main method of contact. This is now the accepted norm in almost all personal and most professional relationships.  In professional relationships it can be easily inserted as this will provide clarity in all matters in concern with all professional relationships. That would include tenant landlord matters in business and personal as well as on the office level.

Employment of Police under false pretenses
In a recent matter one person called the Police to intervene matter under false pretenses. This is  beneficial to you believe it or not. This is by you making the police aware on the spot that any part of the information used to get them to intercede was false in harrassment a positive for you. By doing so as verify in this matter the responding officers are witnesses to the false statement and now will be available to you to testify in the matter. Testimony by an law enforcement official carries tremendous weight.  In the matter I am referring to police have confirmed that the person in the course of the false intervention admitted to other abuse or abuses to which the officers now serve witness to.  As a matter of fact the officers involved  are trained to pick up on duplicious and open ended statements. As noted this in case there was no training needed as the one initiating the false action freely offered the information on their own accord. This was acknowledged by all parties on the spot. A police report of this nature is a very powerful thing for you even though the intent was to strike at at you.

Legal intimidation part 1
Persons trying to enforce legal terms of any type under false pretenses not only is illegal but if a contract is involved, most include  terms have an expectation of a safe positive environment . I can't be more clear as different situations work, rental, or otherwise will define this differently.  Before entering an contract situation  as I found out the hard way, you should have the contract reviewed. If such a clause is not offered in straight forward language have it inserted. This is standard accepted practice.  Many times you will told that the contract supplied is the standard. Unless you have a comparison never never ever accept this. It is a red light with bells, whistles and oohga horns blaring of you need to get legal representation to review said contract. And if the person is being nicey nicey it's a triple ooga you are more than likely dealing with a lowlife shyster. Also be aware in all and any situations you cannot be denied the right to have any document you have to sign or commit to be reviewed by your choice of legal representation.

 About those final words of the last paragraph
This is a case pending where the party who wanted a contract reviewed by their own lawyer was denied. The explanation with the denial given was that the source requiring the contract already had the contract reviewed and that served to satisfy that legal requirement. Of course, they deny that and say they offerred the victim every opportunity to have their own legal representative review the document· Yet, they chose to settle the matter out of court with a very well paid for confidentiality clause.

Legal intimidation part 2
If you have enter into a matter where legal representation has intevened and the other party backs off with an issued declaration of matters being resolve whether in detail or open ended that agreement is binding. What a lowlife scum of the Earth shyster will do is try to go the non-specific route. At times they will even switch lawyers and try to reinstate the original matter without going through the due process required. Don't get upset. The person just handed you the keys to the kingdom. As in one case the person being harrassed was assured by their lawyer "relax you now own him." In doing so the person of interest has opened themselves to being prosecuted civilly and legally jointly. It may even run concurrently. The expense alone will be astronomical.  Due process in some states depending on the suspect parties assertations may start at having to take legal action against their original lawyer. That could take years because in certain case the results could subject the original lawyer  in being disbarred. Most lawyers won't take that lying down in any case. Thier professional reputations are at risk.

Harassment and the Internet
If a person is harassing you in any way visitation to all and any web properties outside of the intent of the web property falls under establish guidelines  for cyberstalking.  Like me all your web properties should have some form of tracking. Google provide indepth tracking that not only reveal the surfers IP their surfing patterns as well on and off your site. I have been employing this for years. No matter what type of harrassment your are being inflicted with the surfing visits are deemed harassment. Also be aware this includes third parties acting on their behalf. "I didn't know" is not an accepted legal defense.

Keep in mind
If anyone has any more questions about harassement situations, I will be glad to answer question if I can. Keep in mind different situations and states may alter the parameters. So all information offered is non-specific and should not be taken as a matter of course without verifying if and how it applies to you. The main message is do not handle harassment on your own terms. The cost of legal representation in the now will save you time, money and aggrevation in the later.  And that last statement you can take to heart fully.

About these matters
The matters being referenced are being prepared for full disclosure including all names and parties involved.  If and when I get the all clear to do so you will be given opportunity to view the full case study with all names tied to the matters and situation.  At this time I am holding back only so that revealing the names and parties will not be used as point to invalidate the outcome. You will be surprised how close to home for many of you this is and many other similar instances. For some it is taking place where you live in your very community and you do not realize it is happening.


If you have a question on the power of  site tracking.
Recently, I became privvy to  an actual event in where the tracking pinpointed addresses of IP origin where a third party has eventually  come forward afterward. The third parties visitation was well documented. That would include viewing a Google map of thier physical address from the tracking info. The third party had revealed they had acted on behalf of someone who is actively involved in the process  of harassing the person who owns the web property.  These people are now open for legal prosecution because they chose not validate information supplied to them before they acted and came forward afterwards as a companion party acting on behalf of the person initiating the harassement. Which means they in all probability will have to pursue active legal recourse against the instigator in the harassment matter as they not only did not give  full  disclosure  they included  a statement already verified as false.  Yes  folks this is a mess that now has the possibility of getting nationwide primetime exposure.  Several sources connected to major news agencies have made inquiries.  

About that last point
If someone asks you to view a website and supply information and they are connected to harassement with someone connected to that website, you are open to be subjected to criminal prosecution. As I said before "I didn't know" doesn't work as a legal defense.  It is your responsibilty to get the facts. If the person tells you one thing than asks for information outside of those parameters that's a sign to stop and  back away. For instance they ask you to review a personal blog. Then in seeming innocence asks for details like day and time that's a red light they are trying to gleam something other than what they have led you to believe. In matters like this the person you trust the most may be the person you shouldn't be trusting at all.

They changed the add comments which is probably why I am the first. Rich babe, there is a lot in here. Many people will profit from this on a personal level. I don't know about anyone else but I hope the news coverage comes out on any of all of these. The thing about the person who profited from the confidentiality clause is bittersweet. They made out but the shysters got off to do it again. You have to think what you do sets the table for the next person. Money usually clouds that reality.

he real question is why are these people like that. Everyone is going to go there goes missy innocent again but I have to tell you in that one it sounds like someone with a sexual identity problem and is frustrated because they can't figure it out. I've been reading ths book where it says some people act badly or do things like that because they don't accept themselves for who they really are. It happens in straight or gay. Maybe the book is just making me think that way. I think it can be a cause of some of this.

Thanks to Lady O for the heads up. I duhhed on trying to comment earlier. I think Rich would be great at tackling the subject of how it is easier for women than men to get a report of harassment taken seriously. You're right this is very intense of a Sunday blog. Rich you probably hit a homerun with more people than you know.
