After our statement was made Friday, we've had a ton of response from many people on numerous message boards. Most were very positive and encouraging. A few were downright ignorant. So I'd like to give some examples and clear up the misconceptions about being in a band on a label.
1. "They signed a bad deal, and should deal with it."
The things we have brought up, are things that ARE in our deal that both us and Trustkill have signed and agreed upon. They haven't made good on their end. We wrote a record and went to the studio and its Trustkill's job to pay the bill. The budget is a dollar amount Trustkill agreed to and confirmed many times in writing that he would pay during a time frame that is now months late. The main problem now is that Devin Townsend hasn't been paid for the hard work he did and its hurting our relationship with him and any future dealings with him.
2. "Josh can do re-releases of any record on the label."
And thats fine, but this was brought up by us a year ago when a re-release would have been appropriate. Doing a special edition release 1 month before a brand new album drops is one of the most untimely things he could do. He's only doing it now because he doesn't have enough money to do a new record and needs a quick fix.
3. "Trustkill pays for the bus and expenses and puts them on tour with Slayer, Manson, HIM etc."
Probably the furthest thing from the truth. Slayer personally asked us to tour. The bus crew, merch, gear is all paid for by us. NOT TRUSTKILL! Ozzfest warped tour, HIM, Manson, all done by us. The only band Trustkill ever got us to tour with was Fight Paris, who we didn't even want to bring, but Josh begged us to bring them as a favor. When we confirmed the Slayer/Manson tour we asked Josh for a little bit of money to make a backdrop and he said "no". We sacrifice a lot to be on the road and Trustkill deserves no credit for any of it.
4. "Bleeding Through are sellouts."
We've been the same for 10 years. Its the "scene" that has changed. We've done some big shows, but its not our fault nobody liked your band.
5. "Just quit the label."
I wish it was that simple. He has the option to "let us go", which seems easy enough, but for some reason with no money in sight, in the eleventh hour he still wont budge. Our options are to give him the record and let him put it out or go through a long legal battle. Other bands have tried the second option and after 2 years in court and thousands in legal fees the band had no choice but to break up. We will not let that happen.
6. "Wipe your mascara tears."
If by mascara you mean the black eyes we used to sport as tribute to The Misfits (aka greatest band of all time) then you got us there.
7. "Van flip please."
Been there, done that. Sorry Lambgoat.
