Hello all.
Under advice of my lawyer (and not without great resistance on my part)
I have agreed to settle the matter with AISD out of court.
With this agreement the district asked that I resign my position as an art teacher at Austin High School.
My legal bills were mounting and my lawyer felt that the settlement was in my best interest. : (

I am proud of the things that I saw happen through this incident. I saw a city come together and celebrate individuality, diversity and love.

There is work to do. I plan on being right in the middle of it.
Meanwhile, I will get my masters and hopefully teach at a university somewhere.


Thank you to everyone who sent words thoughts donations.
I have met some amazing people who inspire hope.

I feel sad but its not all lost. i have made some really great friendships through all of this

I will move forward and do something better.

I am proud to be a part of a growing revolution.


I have learned so much.

You have fought a good fight very publicly with grace.

You raised important issues and awareness in others through your efforts.

I am proud that you didn't just slink away quietly.  I know that watching your struggle reinforced more than just one valuable perspective for all of us and, most importantly, our children.

I am sorry you are sad to settle, but there is no need to ride the machine down to an outcome that is the worst for you.  I hope there is at least a bright side in the settlement.

Now - make more art! and love! and noise!

Hi. Tamara. 'So glad this ordeal is over for you and that you can move on. I confide I remain deeply concerned about the settlement. I'm thinking "does this set precedence, and what are its implications for artists or teachers in the future who may face the same dilemma?" Lawyers will take note of this. Truly, there will be danger ahead for our first amendment rights and the growth of creative censorship. I feel apprehensive...

That said, we are but happy cogs. You've created a wonderful community of free spirits here on myspace.com. I hope you'll keep up your space as the glue of our community. Group online art show anyone? No more of this Austin-only stuff y'all ;-)

you're a brave soul, ms. h. i'm glad to hear there's going to be some closure to this ordeal, but it's a shame that it had to go this far in the first place. you have reaped the support of a community without borders, and you have sown a crucial debate at a critical time. rock the fuck on.

I agree with the guy that said he was worried about the precedent this might set...............but, you have made great strides for artists everywhere....and there comes a time when you have to get on to the better things you are destined for.

I think a master's degree and a university position  are  the best things you could do to combine your gift for teaching and your artistic spirit.................

What can I say.  I probably couldn't have taken it as far as YOU did.  I cannot imagine all  you have gone through.  I'm sure it's disappointing to all of us only because we wanted so much for you to be vindicated and to prove that the photography in question was art, not porn, and, therefore, not wrong!  I'm a realist though.  And we might as well face it.  There will always be those that are narrow-minded and judging.....but, on the other hand, there will always be people like us who understand and are open-minded.  So, the good news is that we are all here, having met through Tamara and Celesta's troubles.  We are richer because of these two beautiful and good women.  We know there are others out "here" that believe and think the same way and that we can come "here" to reassure each other that we are not alone.  Most of all, I am just so happy to have encountered Tamara Hoover and Celesta Danger. Truly.  Gals, this is not a bad ending, but an exciting beginning for both of you. 
Yes, I agree with Chaz. I hope we can keep this community going so that the "movement" continues and stays strong and gets stronger as it goes.  As the old song goes, "This could be the start of something good!"   Love, Squish.

My beautiful friend you sound slightly apologetic(?) You have lost nothing. Settling is a win, the high school has lost a great deal. Because of you my dear dear friend, I have certainly won, it was only your plight that got me try the myspace boogie and I have the most wonderful beautiful friends one could want.

For this my dear lady I say thank YOU and thank you for being and being you!!!

Once again, the truth is revealed....  We've allowed America to become a place where "free speech" is an oxymoron.  I don't want to go off on a rant about it, because for you this is personal.  So instead I offer my personal condolences for any disappointment, and my congratulations as well for bringing your opponents to the table.  Thank you.  I am so glad you got the word out to us all, what you were going through, instead of suffering silently and letting this pass in absolute submission.  I hope that you find contentment without complacency, and that love and passion continue to abound in your life.

  i would be lying if i were to say that i for one am not disappointed by the outcome, but i see how you did what you felt was best.  I just hate to see archaic attitudes and those stuck in a 50's mentality run off a truely quality and inspirational teacher.  As a high school teacher myself, i just feel a sense of loss for the students you have taught and would have in the future. I have no doubt you will find ways to impact the world we live in that have lasting and meaningful effect.  you are something very unique and special in a not so special world.  Peace to you and celesta as well.

Brava!

Tamara Hoover is braver than most will ever be, stronger than she probably wanted to have to be, and was put in a position no one should ever have to defend.  Her bravery and character should never have been questioned to begin with. Her strength was evidenced by her fight. Her relevance is evidenced by the issue at hand, that is much larger and more systemic than one young teacher in a high school in austin.  She didn't wake up one morning like Rosa Parks and decided to sit in the front seat, she was pushed to the front seat and still had a hell of a lot of courage to fight this battle for all the little whimps like you and me that allow our elected officials and right wing nut groups to dictate to the rest of us what is acceptable behavior for those that teach our children. We've allowed the false standards to be placed out there so that things like her being in a art/photgraphy is quesitoned while the character of another teachers vedetta, spite, revenge and ego was allowed to go un-noticed.

Tamara, you are a legend and you don't know it yet.  You set a precedence and it will come home to roost years after everyone has forgotten your name, but you hopefully will not be full of cactus spines because of it, and will still remain the gentle artistic strong woman you were to begin with.

Ohhhhhhhhh Ha!  RA and Brava.

I'm glad this trying time is drawing to a close for you.  I really do think this is going to end with you in a better place.
I think the school board has been exposed for the small-minded people they are and I suspect they regret their action.  I wonder if the teacher and student that got this all rolling have any regrets about their actions?
I'm detecting a sea change in the US.  People are getting tired of the ultra-conservative, holy, get in lock-step with everyone else attitude that has gripped the country in the last decade and especially since Bush became president. Know that your situation and fight has helped lance this ugly boil on the ass of America and that you've been part of the turning of the tide.
Thanks for being a fighter, and good luck with the masters degree!

Whether the settlement agreement is in your best interest depends on its substance; and that, of course, depends on how effective your lawyer is at negotiating.

Had you insisted on a hearing and had you lost, your career would then suffer beyond your imagination.  That is because your employer would then have impunity to bad mouth you forever inasmuch as the judicial decision upholding their decision to fire you is what would give them impunity.

By settling without a hearing, however; your employer has now likely agreed to at least provide you what is called a "neutral job reference," and has now likely agreed that the employment record of your being fired will be expunged.

Chances are, your lawyer was smart to advise you to settle; and you were smart to heed his advice.  It is bad enough to be fired, but it is far worse to be fired and then risk a judicial decision that upholds your employer's decision to fire you.

There is no question that you were dealt an injustice.  But justice is only served, when needs of the wealthy are at stake; and since you are not wealthy, you are incapable of financing the legal counsel necessary to prevail against a government employer whose legal resources are unlimited.

I saw on MSNBC this morning that you've agreed to resign under a settlement agreement.  I'm disappointed but I respect your decision.  It defies logic that nudity should be considered immoral prima facie... obviously by the same people who consider breast feeding immoral; but I wasn't in line to share the consequences if you'd lost. 

I do apologize to you on behalf of 21st century American society, and I hope that ultimately this works out for you.  I trust that the people who came after you will eventually get what they deserve as well.

As a public relations exec, I've tracked this story here locally in Austin and find it one of the more interesting and worthy topics of late.  The challenge for you, Tamara, is your "case" falls into a grey area - by definition, non of the photos or their intent is pornographic by community standards (the unit of measurement the Supreme court created to gauge pornography), nor does it appeal to the prurient sense.  However, as an educator of minors, one is automatically set into a different catagory of measurement.  I'm not saying it's right, but that's the reality.  I support your position 100% and think you've taken the high road and have handled this situation about as well as any client I could have advised.  I am left with one thought from a PR perspective - thank goodness you are an art teacher.  Had you been a teacher of any other subject, this issue would have been portrayed in a COMPLETELY different light in the media and the "story" would not have been what, at its heart, it truly is.  Contact me if you need PR counsel.  I'd be happy to help.

Hi Tamara,

Now that your energies are not being directed toward the negative struggle to press onward with a lawsuit, you can get back to making art and living your life again.  You stood tall throughout your ordeal and revealed the Austin schoolboard to be a group of prudish, confused administrators who couldn't recognize the truly important aspects of the issue before them -- I hope all of the parents in Austin took note and will continue to apply pressure for reform there.

Those are some amazing accomplishments, Tamara.  I am honored to have corresponded with you throughout your struggle.  Thank you for all you sacrificed to bring greater understanding to the world -- in your way -- with peace and love in your heart.  Now you can get back to living a less-stressful life and begin your next project without baggage to hold you back!  Bless you for your strength of character and your willingness to stand up for something so important as the basic human freedom of self-expression.

You are a true-life hero and we are all lucky to have witnessed your strength of character, your creativity and your commitment to your cause.  I hope you realize how inspirational you are!
