Hey, so some of you might have noticed that none of the links to download songs work anymore, and the sites for bomb the music industry, media frenzy design, quote unquote records and the arrogant sons of bitches are completely down. This sadly isn't the standard "oh, I forgot to pay my bills." This is a greater and much dumber problem.

A little over a week ago, I was notified by my web hosting company that I had some files of copyrighted music on my website. The files were songs by ASOB that had been up there for about five years which I had forgotten about. These were songs that I had written. I spoke to a person on the phone who said "well, OK, if those are your songs then never mind." Seeing where this was going, I removed the little bit of copyrighted music I was storing - four 311 albums.

Three days later my site was down, due to having copyrighted files on my site, a violation of the terms of service. The only way I could get my site back up and running would be to mail my registered copyright forms to them. I called the company to explain that a lot of this material was NOT in fact registered with the US copyright office, instead we did the ol' poor man's copyright. The music that was copyrighted was done so under a Creative Commons License, which is a digital copyright that cannot be viewed if the website where the files are posted is down.

It's been a week since my website is down and I keep getting the same answer from these doofuses. I guess the scary thing for me is that it seems that my hosting server (and others who i have spoken to about this incident while looking to move locations) employs a guilty before proven innocent policy, which is terrifying for anyone who does not physically mail forms for every small idea they've ever had in their bedroom to the US copyright office. What a great new digital age, stuck in the trappings of wasteful forms and red tape.

All bitching aside, the biggest trouble here is that I don't have any of the content that was on Quote Unquote Records anymore. As is the routine at this point in my life, my hard drive crashed erasing everything I've worked on this year right before starting work of Scrambles (the same thing happened during Goodbye Cool World, Get Warmer and Pegasuses-XL's The Antiphon). So, long story short, I'm looking for any artwork or mp3s that were put on Quote Unquote Records.

It sadly looks like I'm going to have to do a complete overhaul within the next few weeks, rewrite everything that was up there, and so on and so forth. It might be a minute before the site is back up, so in the meantime I encourage that you check out my friend Dave's website, If You Make It. He's doing something similar to what we do at Quote Unquote and has a bunch of friends bands from Brooklyn and beyond. Bands like the Brass, Get Bent and Halo Fauna have albums, demos, EPs, etc. available for download free there so check it out in the mean time. Plus tonsovideos.

Quote Unquote will be back and better than ever (or maybe the same as ever which is still pretty okay) soon. Potentially sooner we will be releasing Laura Stevenson's awesome new record, which you can hear some demos from at http://www.myspace.com/laurastevenson.

Agreed that this is silly, but just because they took your site down due to a perceived copyright violation does not give them the right to withhold your content. You should be able to contact them and request FTP access to the site and/or get them to give you an archive of everything there, including any databases, email archives, etc.

Or, you could tell them to go ahead and delete (possibly after sending you a copy) all the material they consider to be "in violation" and then put your site back up that way.

Holy fucking HELL dude! Those pube snorters don't even know what they're talking about! You don't even legally have to have any "registered copyright forms" for your material to be acknowledged as copyrighted, you just have to be able to show that you are the original creator. But that would only matter if you actually had the ability to hire a lawyer to deal with this. Barring that, I guess they can just tell you whatever the fuck they want to tell you. I've had friends in the chiptune and NES hacking scene who's websites have been shut down for hosting NES software that they themselves created, on the basis that the programs (which were often not even games) must have been pirated material. I have a communication law book with a lengthy section ..right law, just let me know if you want me to look up some more concrete info for you.

To paraphrase what for some unknown reason is one of my favorite Joel Hatstat sayings, "I have no kudos. None."

How would you feel about writing music using Text Editor? I can show you a really tedious and not fun way of doing this. I want to write more but I have to go to work, which today means setting up shit for Sesame Street Live.

Congrats on getting the word out. A lot of aggregaters now have heard. (I found out through Bannination.com and Slashdot at around the same time) So in the least, I hope this sheds a lot of light onto the situation that you guys were put in and the utter stupidity of the paranoia that is caused by shitty copyright laws. (Not to mention the utter stupidity on the part of the hosting company.)

There are decent hosts out there who won't pull these kinds of stunts. If you need a recommendation, send me a message (so I don't appear to be shilling for one in light of this situation)

There's a few torrents already floating around (posted in the comments here: http://torrentfreak.com/record-label-infringes-own-copyright-site-pulled-081019/ ) of some of the material that was on the site. Hopefully you can recover the rest through archive.org or even a google cache or two. Good luck!

Contact me if you want a hand to pull it all back together - I have hosting and experience and *should* be able to get *most* of your site back the way it was - i.e. just downloaded 'Bomb the Music Industry! - Even Winning Feels Bad' - 3:58 .mp3. Not sure if it helped, but I do some work online, and posted this story on the biggest forum for WebHost owners. Lot of industry people talked a lot about this case and I know that your hosting company is on the forum as well.
