Bill 2712

This bill is all about making the penalties stricter and harsher for any crime that involves people who know a gang member.

It requires police to classify people as "gang affiliates or members" and enter them into a database which can be used against them by the police, even if it is just by common association.

In the bill, the definitions of gangs and gang behavior are so broad and general that it leaves plenty of room for assumption (or racial profiling and violence against youth and people of color). The bill says a gang is "any ongoing organization, association or group of three or more persons, whether formal or informal, having a common name or common identifying sign or symbol, having as one of its primary activities the commission of criminal acts, and those whose members or associates, individually or collectively engage in our have engaged in a pattern of criminal street gang activity"

This bill initially had money for "5 Pilot Programs" to focus on "gang prevention, intervention and suppression" tactics. The amount of money kept shrinking through the legislative session, and now this piece has been removed completely. Now it’s all enforcement, no prevention!

This bill violates constitutional rights like freedom of assembly and the right to bear arms. Self expression will be limited by this bill. This bill changes the law... and it is easier to stop this bill from passing in the first place then to change the laws after.
