All Hypnosis web site owners should be aware of this spam campaign currently underway by HypTalk dot com (link not shown here on purpose). 

The email communication will try to get you to email your mailing list to promote their products as an affiliate partner.  The email says your site was reviewed and out of all the sites "yours was the best" (they say this to everyone). They use canned generic text with a macro that personalizes the message by adding your name into the text at various places. They may even have hired a third party company to do the spam campaign for them.

We know the campaign is bogus as they never visited our site (since we are promoting the exact same products) and they emailed us using our Domain Name Registrar listed email address (one that is not listed online anywhere within our web site).  Also they did not use their real email address in the "reply to" address but instead used a third party email address: g559aad@talktalk.net.  Most all spam email is done this way to keep the main domain name from being reported as a spammer.   

Shame on Victoria Gallagher and HypTalk.  Someone must have given them some bad advice to get them to go along with spamming fellow Hypnosis professionals in this way. If you know her maybe you can direct her to this post.

First of all, just to clarify ... I vaguelly recall that one of my affiliates, against my policy did send out a spam mailing similar to what you are referring to. WE did not send it out, which explains the entire reasoning for your belief that it looks as though it was coming from a third party. Indeed it did.




We actually fired this affiliate from our affiliate roster after that happened.




Again, I am still so curious why you would go to such measure to send a message to me when it's MUCH easier to locate me at orders@hyptalk.com.




It took me nearly a year to find this post!

1) Term of the Agreements: The terms of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. You are only eligible to earn referral fees on sales occurring during the term.




2) Modification: We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on this site. Modifications may include, for example, changes in the scope of available referral fees, fee schedules, payment procedures and Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUING PARTICIPATION IN THE PROGRAM, FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.




3) Limitation of Liability: We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. 4) Independent Investigation: YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.




5) SPYWARE AND OTHER PARASITES: Any affiliate suspected of a relationship, formal or informal, with any provider of spy ware or parasitic software (as judged by any interference with the operation by design of MERCHANT and/or its partner sites) is subject to punitive actions by MERCHANT, without notice, including but not limited to: suspension of affiliate account; termination of affiliate account; withholding of payments to affiliate; and public notification of affiliate's suspected malfeasance. MERCHANT encourages affiliates to report suspicions of such relationships; and, should substantial proof, as judged by MERCHANT, be provided, MERCHANT reserves the right to assign a value equal to unpaid monies earned by the offending affiliate (or a part thereof) to the reporting affiliate as a bounty.




6) COMMISSIONS: Commissions shall be paid to *qualified sales on the first of every month through Paypal. If you do not have or intend to open a paypal account, you will not receive commission. There will be exceptions made to affiliates to especially ask for a handwritten check to be sent. It is at our sole discretion to honor such requests. *A commission will be disqualified if there is no visible link from your main site that you submit to us that we can easily find and click through to determine if the sale is legitimate.




7) COMMISSIONS SUBJECT TO CANCELLATION: If we receive a return on an item in which we paid you a commission, we have the right to reverse that commission. If you have already been paid the commission for a sale that gets reversed, it will be deducted from the next available commission payment.




8) Pay-Per-Click Keywords: You may use PPC advertising, such as Google Adwords or Yahoo Search Marketing or similar programs. However, under no circumstances can you use PROPRIETARY Brand Names to direct affiliate traffic to the site that would ordinarily come up in our natural search listings. Key word listings that include keywords such as Hyptalk, or any form of that keyword are strictly prohibited. Additionally, keywords which include Victoria or Wizell are also strictly prohibited. You can certainly bid on them, but commissions will not be paid on sales derived through those linking methods. You may only use generic words, such as Hypnosis, self-hypnosis, hypnotherapy, hypnosis cds, etc... But, not entire product names; such as “The Ultimate Weight Loss Power Pack” For example, you may use weight loss, weight loss hypnosis, hypnosis for weight loss, weight loss cds, etc. But NOT exact title names. If you have any questions about this, please email us before bidding on key terms.




9) LINK HTML PROGRAMMING: You are responsible for programming the html of your own website. We provide you with the code but we assume zero responsibility for broken links and we are not equipped to provide html advice.




10) Hyptalk. com, LLC has a ZERO tolerance policy for SPAM. The only emails that are acceptable to send are the ones you send from the admin page of your affiliate account that is directed in a personal way to somebody that you already have a relationship with. Or, if you manage your own opt-in email list on a website which relates in some way to our products. In other words, gaining email addresses from the internet or newsgroup or purchasing list and sending an unsolicited email is strictly prohibited and will result in the ultimate termination of your account and any commission or 2nd tier affiliate accumulated using the above method, will be null and void.




11) Hyptalk. com, LLC examines the integrity of each website before approving it.
It is at the sole discretion of the owner of Hyptalk. com, LLC to approve or decline affiliate accounts as we best see fit.
If your website, OR LACK THEREOF, does not relate to the topics of the products Hyptalk. com sells, you will likely not be approved.
