Regarding Espermachine's departure from Radio-Active-Music:

Under our agreement, the profits from the CD sales were to be distributed 50/50 between the label and the artist. Both parties agreed that this was to be achieved by Radio-Active-Music.com presenting the band with half of the copies of the CDs up front, with the label retaining the other half. Each party would sell their copies, with both retaining the full sale price.

In April 2009, Radio-Active-Music provided Espermachine with their half of the product. The band had since sold their stock, and asked to be sent more copies. Radio-Active-Music explained that if the band was to take more of the label's stock, they would need to be purchased at full price, to retain the deal as brokered.

Espermachine has since claimed this is a scam, since the label will not provide the band with more CDs than their agreed share. Since the initial pressing, there had been one reorder, and the label therefore owes Espermachine either 12.5 CDs, or $125.00. (The reorder being 25 CDs, mostly sent to distributors and has yet to be sold.) Instead of waiting for this clarification privately, the band chose to defame the label publicly. Radio-Active-Music will provide the band either the CDs or the money as well as the final amount owed for digital distribution, and will cease working with Espermachine.

Since Espermachine has decided to continue spreading bad information regarding our agreement, here are more details that the band has decided to leave out.

Radio-Active-Music fronted the money for the release, as usual with most of our releases.  However, when the band's graphic artist failed to meet the deadline for the pressing in order to have the CDs done in time for the first tour, the owner of Radio-Active-Music obligingly stepped up and designed the artwork herself, free of charge for the band.  (CD artwork usually runs around $300, give or take.)  And, again as usual, Radio-Active-Music also covered all costs associated with distribution and promotion of the album.  This includes everything from iTunes, to flyers, to show promotion, to promo copies mailed to ezines and DJs, to the copies of the CDs that were mailed Priority to the band to make it in time for the tour.

In addition to the above, while the band was in town (playing a show that Radio-Active-Music had booked for them, of which Radio-Active-Music took NO booking fee), the band's vehicle broke down.   All of the auxiliary members of the band quit the band that night, leaving the front man stuck, by himself, in the city.  Radio-Active-Music provided lodging and transportation for him that night and the next day, until he was able to get his car fixed and head off to his next tour date.

All told, Radio-Active-Music estimates that the company has spent approximately four times the amount of money that has been recouped from sales.

The band spent $0 on pressing, distribution, artwork, and promotion.  The band has since made $250 on CD sales, plus the undisclosed amount from the show we put on for them in DC.

Those are the facts.  Radio-Active-Music has an excellent reputation for treating our bands well - we promote heavily and we offer a high percentage of the sales to the bands, because we care about the music.  Everyone on staff with the label still works a fulltime job outside of the company in order to finance these projects that we believe in so strongly.  We sincerely believe in every band we sign, in every CD we put out there to you.  It's not about the money to us, which is what is being suggested.  It's about keeping this style of music we love so well alive.

This makes sense.  Otherwise, the band would be taking more than 50% and therefore the BAND would be violating the agreement.  I hope EM sees this, apologizes, and gets their last 12.5 CDs (hell, be a sport and round it to 13).  Or I suppose EM could give you $125 and have 25 more CDs to sell, right?

There are too many obvious solutions if EM wants to take a different course here.
