So I get this phone call yesterday from Cleveland Ward 11 Councilmen Mike Polensek.  (For the record, Mr. Polensek seems like a nice guy trying to do a good job for his city.)

 

Mr. Polensek has received numerous calls regarding some offensive, pornographic art the gallery window.  When I ask Polensek for more details, he informs me that the art in question is titled "Black Pussy" by Staci McNasty.  The mixed media piece is not in the window, but very visible from the sidewalk.  (If you have been to Low Life, you know that the front of the building is just about all windows!)

 

Turns out that some people feel this piece is racist.  Unfortunately, the people that complained never once stopped into the gallery to discuss the issue or attempt to contact me prior to filing a complaint. 

 

As a side note, the building that Low Life occupies was vacant for over five years.  So much for "welcome to the neighborhood!"

 

Art, just like life, is not always cute, safe, or politically correct.  Art is often a reflection of life and life in Cleveland at the moment is not all sunshine, rainbows, and unicorns.

Know one thing: politicians are the enemy. They are the ones taking away our rights and we the People do nothing about it. Use this as an oppurtunity to advocate our freedom of speech.
I'll back you 1 zillion percent!! What does that moron Polensek want from you? The show's over!!

A.P. I have nothing agianst Mr. Polensek and as I stated, he seemed like he really was trying to listen to his voters. That being said, I did state that there might be upcoming shows that might prove to be controversial. It is my goal to be a strong gallery for free speech as well as a good neighbor. Sometimes the two goals might be at odds. When this happens I'll defer to the U.S. Supreme Court ruling on this subject.

The Surpreme Court ruled in Roth v. United States, 354 U.S. 476 (1957) that the test for obscenity was "whether to the average person, applying contemporary community standards, the dominant theme of the material, taken as a whole, appeals to the prurient interest."

The Roth test was expanded when the Court decided Miller v. California, 413 U.S. 15 (1973). Under the Miller test, a work is obscene if it would be found appealing to the prurient interest by an average person applying contemporary community standards, depicts sexual conduct in a patently offensive way and has no serious literary, artistic, political or scientific value. Note that "community" standards—not national standards—are applied whether the material appeals to the prurient interest; thus, material may be deemed obscene in one locality but not in another. National standards, however, are applied whether the material is of value.

The art in question was purchased for $100.00. In today's present economy, $100.00 still has value.

Is Sign Guy serious? Maybe. I've seen some of his "dark art". Anyway, Polensek should have stopped down to see the painting himself. Besides, the artshow is over. What difference does it make if someone sees it from afar and doesn't like it? If it was a statue of the virgin Mary covered in poop it would be ok to them. Not everyone likes or understands EVERYTHING! And that's why freedom of speech is to be respected. If a Barry Manilow fan doesn't like my Black Flag record should I hide it from them so their not offended? Geezzz!! Keep up the great work, Dave.

Props to you Dave for not backing down from controversy! Was the councilman asking you to remove the art? I haven't seen it, do you have a pic you could post of the piece? I really agree with your statement that art is a reflection of life and life is not always pretty.
