Well, it is a sad day for us as the city clerk here in town has denied us our right to freedom of speech and claimed we need a business license to do our free tours here in Tombstone. We always did our tours fee, and funding a license out of my pocket is a bit much to deal with when we only do this as a hobby and get no financial gain. They have also decided to make us close our CafePess account down claiming it is also a business. We will abide for the simple fact that we do not have the money to support a lawyer. We always supported other companies and try to support our town the best we could. We however are a small group with a hobby. The claim that our website looks like a business, is pushing it a bit far, so we plan to leave that up.

Here is how you get around the red tape, and then you guys will be able to do what ever you want. You can do it all yourself without a lawyer! (for about $50 bucks and a lot of time in reading and paperwork)

Go to: http://www.azcc.gov/divisions/corporations/filings/forms/index.asp
Click on: CF0041 Articles of Incorporation for Tax-Exempt Non-Profit Corporations
(includes instructions) 05/03/2007 -----Looks like it will be about $40 bucks to file. $75 bucks if you want to expidite the filing.

Then Apply for an EIN number with the IRS under a Social Club -"A social club is organized for leisure, recreation, or other similar non-profitable purposes. Some types of social clubs include sailing clubs, hiking clubs, art groups, etc."
If I remember right it doens't cost anything to get an EIN, or it may be a very small fee.

After you have your Non-Profit Organization information filed and you have your EIN, then file for your Business License here:

It looks like it will cost $13.00 for that.

Then read this entire document (IRS 1024) (Trust me it is boring, but not that hard to understand) http://www.irs.gov/pub/irs-pdf/k1024.pdf
After you are able to do so, you will want to complete the application for a 501(7) not a 501(3)
A 501C(7) is for a Non-Profit Social Club. It is not the same as a 501(c)3 you may have to pay certian taxes on income and even donations after they reach a certian point. This one is not cheap. It will cost 300.00 for the filing fee alone.

I know it is a daunting task, however that will allow you to do anything you will ever want to do with your organization.

This is indeed sad. Since Tombstone attracts thousands of visitors throughout the year, it seems the town would appreciate your free tours as an additional incentive for folks to spend time and money there.

That's a shame! Try to ask around to other affiliations who do ghost hunting and see if anyone has ever came across the same type of issue. Some one someplace must know of what can be done to get around this.

Don't give up, just get as much information as you can, knowledge is power, don't let the big guys push you around.

You don't have to answer any of these questions...... but they come to my mind as I try to understand the idiots who decided to do this to ya'll.

Did they look at your income in this hobby?
Did they want to see tax records?
Why are they so pushy pushy about this issue?


I think they are just trying to drum up all the $ they can for the city... Which seems like they would want to work WITH you and not against you. Ghost hunting and ghost tours are REALLY the thing nowadays... and that's what attracts lots of tourists. Tourists + Tombstone go hand in hand.

Oh, well, I'm just ranting. I hope you can appease them.... keep up the good work, and don't let 'em get ya down!!

Unbelievable.


Any city should be happy that an organization (no matter what it is) is promoting local tourism, and bringing in a cash injection to the local economy. I would imagine that in your area, the main tourist draw is "Wild West" history, and the possiblity of seeing a ghost.

Glad that you're leaving the site up. They have no right to shut you down. You aren't in this for financial gain, and who are you hurting? They are like a lot of cities now. They want to control every little thing because they need that money. There is such a rich history there that people want to know about. Don't give up. Keep fighting!!!!
