Well, here we are...another new year and another high-profile cold-blooded murder of an unarmed black man by racist police. When will it stop? And what does our community do in response?

Oscar Grant, R.I.P. Could've been you, could've been me. Or our brothers or fathers. Hell, it could've been our wives, sisters and mothers too, especially when sexual assault is added to the list of offenses pigs perpetrate against us. I've been saying it for years. The police do not have our best interest at heart. I've also said for years that the only language America speaks and understands is violence as it relates to people of color and those on the lower rungs of the socioeconomic ladder. Maybe it's time we speak back in a language they can understand.

I've seen the new efforts by the media to spin this story by attempting to create sympathy for Oscar's killer. It won't work...the brutality has gone on for too long. Even if the officer wasn't racist in this case, the end result is still the same - another black man dead at the hands of the police. And I've heard the calls for calm after our brother's murder and to stop the violence...and I disagree. That's all we ever hear when we respond vocally to brutality perpetrated against us. It's now time for people to be held responsible for their actions - physically. If an eye for an eye will make the the whole world blind, then I guess we'll all be bumpin' into shit, 'cause this has to stop now.

Of course, it's also important to analyze the fact that many of us have become desensitized to Black Death anyway. It's sad, but true. Look at the murder rates among our youth in major cities nationwide - the statistics are numbing. Where is the collective sense of outrage there? Yeah, we complain and say how sad things are, but we don't galvanize our anger into even temporary action when black on black violence occurs around us on a daily basis. It's easy to blame those who perpetrate the violence, but the reality is that society in general, and black elders in particular, have failed our youth. But that's another discussion altogether.

In some instances it really is better to be feared than loved, and right now, nobody fears black people but other black people. In this country, police, corporations and government all do whatever they want to do, with no fear of retribution and no accountability to the public. They either lawyer up or pay fines when caught doing wrong. That's not where the problem started in terms of their collective dealings with us, of course (racism set it off), but that's where it is now. In many other countries authority figures fear the people...not the other way around. We need to be more like them.

I've said for a long time that the only way real change would ever occur here is if those in power were concerned about their actual well-being when making decisions that affect all of us. As it stands, they don't. So I say, let 'em start coming up missing. Let Johannes Mehserle come up missing for Oscar Grant. Let Michael Oliver, Gescard Isnora and Marc Cooper come up missing for Sean Bell. Let Powell, Koon, Wind and Briseno disappear for Rodney King. Hell, while we're at it, let the members of congress feel the heat for repeatedly funding these racist and illegal wars - wars which result in not only profiteering for them and the death of people here and abroad, but in economic violence being visited upon those who can least afford the hardship here at home by way of budget reductions in social services and education to pay for these same wars.

Because the cold, hard reality is this: IN AMERICA, BLACK LIFE MEANS NOTHING. Nothing that is, unless you're an entertainer or sports figure. But the average brother or sister? Forget about it. Don't the "Obama-era" euphoric kool-aid fool you. Racism still exists in the country, and the struggle did not magically disappear once he got elected. Make no mistake about it: Oscar Grant is us, and his situation is a reality shared by far too many.

Hopefully we won't see the same course of events take place that always seem to happen - brutality/murder, then outrage, the protest, then acquittal, then more outrage...followed by a cooling off period and eventually back to business as usual. That's why I don't fuck with protests - the powers that be do what they want to do regardless of what the people say. They damned sure didn't listen to the millions of people who hit the streets in every major city in America during our lead up to the Iraq war. Besides, as a Black man and someone who's concerned with our condition, I don't advise any of us to engage the police unnecessarily. Too many of us are in the system as it is, and too many of us get brutalized as it is.

All that aside, the best course of action for most of us is to minimize situations that actually call for us to have interaction with the police at all. But if you are ever in a situation that calls for dealing with law enforcement, it is best to know your rights when engaging with police, as well as some common sense solutions:

The following is meant to give a brief overview of law enforcement and how to protect yourself from unnecessary legal entanglements. Of course, Oscar Grant adhered to these principles - which is why we are outraged - but it's still good info to pass on. Besides, if it's on, it's on...but here's a brief rundown of things everyone should be aware of:

This government's system of laws exists to maintain the dominance of those in power, and the police are its armed enforcers. If you doubt this for a minute, look at who are the selective targets of local laws: The homeless, the young, the poor, dissenters. Globally, look at who dies and who gets rich from our wars and other disasters.

For 250 years in this country, the government and their enforcers have consistently fought against people working for liberation: Indigenous resistance, land reformers, slave revolts, abolitionists, labor organizers & workers, free-speech advocates, women's and civil rights workers, anti-war and anti-globalization protesters, and recently, animal rights and environmental activists.

Your relationship with the police is at heart adversarial. While there may be cops with hearts of gold, the job of all police is to arrest and prosecute you. As such, it is almost never in your best interest to cooperate with them.

Keeping yourself safe and resisting the police state comes down to these simple principles:

1) Non-cooperation: If you talk with the police, you could unintentionally hurt yourself, your friends, or others.

2) Do not consent to searches: Never give law enforcement the okay to examine your pockets, car, backpack, or home.

3) Remain silent: Say nothing except "I'm going to remain silent, and I would like to see a lawyer."

4) Talk to a lawyer: Never take advice from the police, they may try to trick and mislead you.

5) Use trust and intuition: Work only with people with whom you have a history of trust. Without being paranoid, trust your intuition.

Rights During a Police Encounter

In a police encounter these rules will help protect your civil rights and improve your chances of driving or walking away safely. From here on out, we are talking about your legal "rights" guaranteed by law. Though in our view, what you can do and what you can do legally are two different things. All of these rights also apply to minors and non-citizens.

Keep Private Items Out of View

This is common sense: Always keep any private items that you don't want others to see out of sight. Legally speaking, police do not need a search warrant in order to confiscate any illegal items that are in plain view.

Stay Cool & Politely Assertive

Police are well armed and often unpredictable, so remaining cool and calm will keep you safe. Treat them with the caution you would treat a dangerous, wild animal.

Be polite and yet assertive to ensure that your rights aren't trampled on. Some officers may come on heavy if you are not absolutely submissive, but standing up for your rights will keep you safe in the long run, in court when it really matters.

Determine If You Can Leave

You don't have to talk to the police. As soon as an officer approaches you, ask the officer, "Am I free to go?" If you get an answer other than a definitive "No," gather your stuff and leave without another word.

You have the right to end an encounter with a police officer unless you are being detained or arrested. Don't waste time trying to determine your status. Test if you are free to go, and then go. If you aren't free to go, the officer will make it perfectly clear.

Use the Magic Words

If you are detained or arrested, use the magic words:

"I'm going to remain silent. I would like to see a lawyer."

Do not talk to police. Wait to talk to a lawyer representing you. Even casual small talk can come back to haunt you. Anything you say can, and will, be used against you.

Cops have numerous tricks to get you to talk. They can and do use fear, solitude, isolation, lies, advice, playing you against others, and even kindness to get you to cooperate. Don't be fooled. If you need to say anything, repeat the magic words.

Keep in mind the credo: If no one talks, everyone walks. Regardless of what you are told by an investigating officer, you have nothing to gain by talking to the police...and everything to lose.

Refuse to Consent to Searches

Officers seeking evidence will often try to get you to allow them to search your belongings, your car, or your home. Refuse to consent to a search, with the phrase:

"I do not consent to a search."

Usually, a search request will come in the form of an ambiguous statement, such as, "I'm going to ask you to empty your pockets." Answer such requests unambiguously. Repeat as many times as necessary.

You are under no obligation to allow a search. The only reason an officer asks your permission is because he doesn't have enough evidence to search without your consent.

Police officers are not required to inform you of your rights before asking you to consent to a search. If the officer searches you in spite of your objection, do not resist. Your attorney can argue that any evidence found during the search was discovered through an illegal search and should be thrown out of court.

Do Not Try to Bargain

Police officers will often tell you that your cooperation will make things easier for you, and many people hope to be let off easy if they are honest and direct with the police. The only thing it makes easier is the officer's job. Do not let the threat of arrest scare you into admitting guilt. Better to spend a night in jail, than years in prison. Ask to speak with a lawyer, and remain silent.

Where to Go For More Help

If you feel your rights are being violated, hold tight until you can talk to a lawyer. If you don't have your own lawyer the court will appoint the public defender to defend you. For more information about your rights, law education, and what to do if your rights were violated, check out:

you hit on some very good points, and it's all pretty interesting, but if you walk around with an M4 grenade launcher in the streets, I bet the police will stop you. Paris has it right..., the way to bet these bastards is to prove that we don't need them. And we do that by living our lives the way that we want to, and fuck anybody who doesn't like it. Corpus Dilecti is the common law sense of how things should work, and where that matters is when we're called in for jury duty. That's where we need to make our difference because that's where we still have the power to influence things. I can't stand people who don't serve jury duty. It's like god giving you the chance to change the world 12 people at a time.

I wonder how many similar stories could be collected from just the first week of 2009 if everyone across the country contributed.....Thanks for all the information, it is useful, but only if one is given the opportunity to use it. Again, it's shoot first, dialogue second.

Paris, I've been feeling your shit since '92 and I just want to thank you for opening my eyes years ago. What happened at Fruitvale BART disturbs me more than words can describe. I may be white but I've never been rich and I too have been the victim of police brutality—had my ribs broken while handcuffed. I can't believe Oscar Grant's killer is still walking free. I think the BART board, the Alameda Co. DA, the Oakland Police, the whole damn world needs to see how pissed people are, and if that means breaking and lighting up shit so be it.

Having recently gained a concealed carry deadly weapons permit, I exercise even MORE caution when I deal with the police. What you've said rings so true in a lot of cases. ....I would reccommend doing some research on the Black Panthers in order to see how they handled the police. Back in the day, Professor Seale would actually quote the statutes that applied to any given situation. If you know your rights and THEY know you know them, chances are they'll think twice about violating them.

Where is the outrage for blacks who kill other blacks? That is definitively more common than police killing blacks, whether by racism, by accident, or, yes there are some, in self defense and in order to save someone else. Your Crusade against the police is telling.....why have law at all right? The same stupid gangsta rappers who brag about keeping it "real" will be the first to call the "po-po" when another black man tresspasses on their Bel Air lawn. I seriously doubt you wouldn't call the police when in trouble... To make outragous claims as this blog does is insane and factually incorrect. Obama got elected and, as I would have guessed, victim politics has never gone away. Do you know how many white people have been accidently killed? Do you know of cases where black cops killed someone based on their race? We'd never know, because it never gets reported. Dividing us on race over issues like this are stupid. No one is keeping the "black man down" anymore with any bit of credibility. Get over it, go to work and live your life. Try supporting the good officers who really want to clean up the neighborhoods, instead of pissing on all of them, because some of them are bad, racist, and evil.

But pig apologists like you are the brain dead Hannity-influenced types that can't see anything wrong with things the way they are. Outrageous claims? Fool, every thing here is factual. EVERYTHING. No victim politics here...but plenty of dead victims. Police do wrong by everyone, sure...and maybe white victims are underreported...but there was no intent to divide over race here. You read into it what you wanted to. Seems like YOU want a racial divide. "Get over it" is some classic racist asshole neocon sheep mentality bullshit. I HAVE a job, have employed a lot of people, have provided scholarships and low income housing, and have been true to my beliefs throughout my career. Murder by cop is a threat to society itself. It violates the public trust and when a murderer infiltrates the justice system itself, that makes it the most difficult crime to solve. ....In this case the cop was caught. But in order to deter this horrible crime there must be severe penalties. ....The cops who saw this crime did not respond correctly. They should have drawn and fired on the other cop as soon as he drew his weapon. There was obviously no reason for him to draw his weapon. Nevertheless, police across the USA should be trained to react correctly to the possibility of a cop turned megalomaniac killer.....If this cop is not executed, how can any execution be justifiable?....This is another gut check of our resolve as a people. If we do not respond to this, we will be next. Bet on it.

I have to disagree with you. Police is not rough only with Black people. I am not Black, I was in my house and they still beat me up and I ended in jail, after they illegally entered my house... ....People speaking with an accent, are targets also... ....Bottom line is avoid police as much as you can. If you run into one that does not let you be though, don't have a negative approach. If he is asking you something, don't say, "I am not talking until I get a lawyer". Say, "I would like to answer your question after I consult with my lawyer"... ....If Police knocks at the door, never open the door. If they have a warrant they will break it anyway, if they don't they will have to answer for breaking it down, and they can't say that they were invited in the house. ....For the last eight years America turned into a police state, as bad as the former Communists dictatorships. The only difference is that those were crude, while our people try to be more refined... They don't always manage, but they try... ....And if you want to fight this situation, make sure you turn the TV off when a cop show is scheduled... ....And the best thing anyone can do, is to learn the law and your rights. They will try to intimidate you, however if you know your basic rights, there is nothing to worry about... Anyone has rights being a citizen. However if you don't know them, ignorance is a killer...

off the subject a bit but i feel a correlation. ..............................Greetings. My name is Nate, I'm now a San Francisco resident since I have come back from my time in Iraq. I didn't become politicized until I saw first hand the devastation, mayhem and destruction we as a country had inflicted and brought onto the people of Iraq who were basically no threat at all. I served as a .50 cal gunner on the lead gun truck on convoys for at least six out of seven days of the week if not all seven. We hauled KBR products from FOB (forward operating base) to FOB all throughout Iraq. I'm writing this to thank you for using your platform to educate and spread the truth. I've witnessed the lies and manipulations, the rewiring and molding of everyday people into automatons and serial killers. I've watched drivers on the gun truck I was manning take count of the vehicles they had bashed into as if it was some kind of video game and then to top it off, come back to the FOB and boast about the damage inflicted. The same goes for other .50 cal gunners. I watched the transformation of everyday Joe's and Jane's turn into serial killers. The same roads, I'd traveled on while manning the .50 I never had to put a shot into somebody. Some of these guys would come back pleased as shit with themselves for “getting one”. The deception and bully tactics the military uses itself can't be summed up within this message but it's more than fair to say that the ROE (Rules of Engagement) are nothing more than a policy on paper to cover their asses. Our XO's would nearly advocate to shoot at will. If you felt you were under any threat at all...shoot. And mind you that from the get go, from the briefings before deployment they pumped stereotypes and fear into our minds. I guess I was wise enough to see through the bullshit. Anyway, I created this project as a form of therapy for myself. I've been diagnosed with severe PTSD (post traumatic stress disorder), TBI (traumatic brain injury) and a whole lot of other shit that I'm fighting the VA on right now and another thing, it's no myth that once the military is done with you that the government doesn't take care of it's veterans. I'm living this first hand. I've watched 28 innocent Iraqi day laborers getting paid piss poor wages to build Camp Cooke into a mini-mall get blown up by a VBID (vehicle born improvised device) , I was nearly blown up by I.E.D.'S (improvised explosive device) five times, I seen the death from mortars and have felt their wrath, I watched rockets skip across the ground no more than twenty yards in front of me and for the VA to be like “prove it” you can't help but to get pissed off. Anyway. Please keep up the good work, get the word out there, keep telling it like it is. If you ever need a reference of first hand experience, do not hesitate to ask. Hi Paris ......I am writing this to you for the same reason I did write on your other blogs to express my thankfulness to you for using this platform to reveal what the governments in the world do undercover. Further I thank you for using this platform to educate, to talk the truth, to spread the word. It's so important in this time. Many are not aware of what's going around them or do not care about or suppress it, because they're doing fine having their jobs making good money, it seems that they don't need change in their lives. They have everything they need and still want more, so they are hardly interested in the truth.........Well, we need leadership and organs looking for order like police. There are police officers doing a good job, but human beings are weak and we cannot think weakness away. For all the police men doing a bad job I just can say: “FUCK THE POLICE” – they are dangerous idiots!......They are the cause for more crime anyway and should immediately be suspended from office!......I can tell you that Europe will turn into a police state worse than former GDR and I think that America is on the same way too, even more.-because of fear and ignorance, and ignorance is a killer. Fear and ignorance are reigning in the world – selling cloud-castles to dominate with altruism. Everybody should know about his rights and stand up like Black Panther's. They did not kill unless they were defending themselves. They did demonstrate the rights that black and white are under the same law!!! Many white man was disagree with the truth, even FBI Boss Hoover who did find only one way to stop the movement: He did agree with the Mafia that they could sell their drugs in the black townships of Amerikkka's cities and keep the white’s areas clean. Through the influence of drugs black people began to kill each other, it happened more than 5 decades ago. ......This days killing continues as something quite natural: Eye to eye…you know the story. I remember on one of your album's covers you had a police car with "666" on it, so I think you're agree with me and I hope you're not thinking that I am talking nonsense...ah yeah, by the way you also put on the same album the parable: “A coward dies a thousand deaths, a brave man dies but once” How true, that’s real talk, brother!......Like I told you before, I am not religious. The fruit of religious people we all no, they justify racism with the bible verse in the book of Genesis, chapter 9, verse 27: “May God extend the territory of Japheth May Japheth live in the tents of Shem, and may Canaan be his slave” Noah said this and cursed Canaan. As I heard in the South-states little white children had to learn this at school, a seed of hate was planted! Further if we look back into history, the whites did believe that they are a superior race - I see why somebody's saying "white man has a God complex" and it was true! And it is still true by many ignorant people, idiots and brain-amputees. Now they even fear black people, they are afraid that the black is overtaking the white race, which is also one reason why many black men have to suffer, just because of baseless fear! Hm…”A coward…”......I was travelling South Africa, was living in by black brothers in black townships, even before I've been told those people would kill me because I'm white (Bullshit, or if not bullshit how would i be able to write this now;-), where I experienced real life and not this plastic life shown to the tourists visiting South Africa. Anyway there is much to tell.........Please let me end here sharing with you one of the most vehement challenges in my life, because I really believe that it is a key to change many things in this world: This I quote from the Bible, Romans, Chapter 13, Verse 1ff: “Everyone must submit himself to the governing authorities, for there is no authority except that which God has established. The authorities that exist have been established by God. Consequently, he who rebels against the authority is rebelling against what God has instituted, and those who do so will bring judgement for themselves. For rulers hold no terror for those who do right, but for those who do wrong”.......It's not so easy to understand nor to follow it, but God requires this from us. We must confront the authorities when we see that they're doing wrong, but we have to confront them with respect and honour, like this we can honour our God and God will honour us. Believe me, try it and you will see how it works! If we submit ourselves to the word of God our life will be blessed!......
